COMFORT ROAD TO THE MIDDLE SCHOOL PROPERTY WITHIN THE RUPPLE ROAD RIGHT-OF-WAY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section l That the City Council hereby approve an agreement with the Fayetteville Public Schools for construction of an 8 inch water main from Mt. Comfort Road to the middle school property within the Rupple Road right-of-way; and authorizes the Mayor and City Clerk execute said agreement. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 1. The City agrees to furnish or cause to be furnished all labor, matenals and equipment required for the performance of the following described work in connection with installment of a complete eight inch water main to extend to the School's south property line on the new Rupple Road. The water main shall be to the City's standards with the required 12x8 tap, bore and encasement under Mount Comfort Road (if required by Washington County), eight inch main within the Rupple right-of-way, fittings, valves, fire hydrants and any appurtenances necessary for a complete water main installation to extend to the School's south property line on the new Rupple Road. Further, the City shall provide all normal engineering services including design and construction management for the eight inch water main extension. 2. The School agrees to compensate the City for the actual costs incurred for services, activities and undertakings, including, but not limited to, construction and testing. Such costs are estimated to be as set forth below: A. Tap existing 12" water line and bore Mt. Comfort Road in rock. 1. 12"x8" Tapping Sleeve, Valve and Tap $ 3,532.00 2. 75 L.F. Highway Bore per plans in rock 16,438.00 B. Water System Improvement Rupple Road 1. Install 8" waterline with valve and fittings Per plans and specs approximately 720 L.F. $20,058.00 • • • • • AGREEMENT PAGE 2 2. Rock Excavation -unit price Estimated quantity 35 C.Y. @ $120 C.Y. $4,200.00 * Rock excavation -work shall be measured by the cubic yard of rock excavated. Rock shall be computed by cross section method and venfied by the Project Engineer. C. Fire Hydrant D. Project Contingency (15%) for an amount not to exceed $53,334.70. 2,150.00 6,956.70 3. Payment shall be due within thirty (30) days from the acceptance by the City of the eight inch water main extension. Jim Beavers, City Engineer Date: January 10, 2000 Re: Water main extension to serve the westside middle school. Proposed reimbursement agreement. Proposed authority to approve a construction contract. The westside middle school is under construction north of Mount Comfort Road and west of the new Rupple Road extension (also under construction). The School was to receive water from an agreement with the developer from whom the property was purchased. The developer has been unable to fulfill this requirement. In order to provide water to the School and to keep from delaying both the School and the City's contractor on the Rupple Road extension the following two Resolutions are requested: 1. Approval of an agreement with the Fayetteville Public Schools for construction of an 8 inch water main from Mount Comfort Road to the Middle School property within the Rupple Road right-of-way. Such agreement is attached as exhibit "A". 2. Authorize the Mayor to approve a construction contract change order with APAC (McClinton- ' Anchor) the City's contractor for the Rupple Road construction project up to $53,334.70 for the installation of the proposed 8 inch water main from Mount Comfort Road to the Middle School property, contingent upon approval of the agreement in item one above.
