A RESOLUTION ACCEPTING THE RECOMMENDATION OF
THE PARKS AND RECREATION ADVISORY BOARD TO
ALLOW A WAIVER FROM THE PARK LAND DEDICATION
ORDINANCE TO ACCEPT MONEY IN LIEU OF A PARK LAND
DEDICATION FOR RAZORBACK ESTATES SUBDIVISION.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARICANSAS•
Section 1. That the City Council hereby accepts the recommendation of the Parks and
Recreation Advisory Board to allow Lindsey and Associates, owner/developer, to pay $68,400 in
lieu of a park land dedication for Razorback Estates Subdivision.

SUBJECT: Waiver of the Park Land Dedication Ordinance 3793
Razorback Estates is a proposed 228 multi -family development on a 22.5 acre tract located on
McConnell Avenue and Highway 71 Bypass immediately north of the Washington County
Fairgrounds. The owner is Lindsey and Associates with Crafton, Tull and Associates as the
engineers. Razorback Estates included in their design the following recreation facilities for their
tenants: playground, clubhouse, swimming pool, tennis court, volleyball court, basketball court,
Iwo lakes, AAO (Arkansas Athlete Outreach) Clubhouse with patio area, AAO basketball arena,
and AAO football field. The requirement for the park land ordinance is 4.56 acres or the money
in lieu is $68,400. Park staff toured the site with Crafton Tull and recommended money in lieu be
accepted as the requirement. The plat was brought before the Parks and Recreation Advisory
Board on March I, 1999 with their recommendation to accept money in lieu of land.
The recommendation to accept money in lieu as the park land requirement was based on the
following justifications:
h is not in a priority area for a park in our Master Plan.
The development is located adjacent to the Washington County Fairgrounds containing
47.4 acres. It is also served by parks in the area containing over 70 acres.
The development preliminary plan provided a substantial number of recreational facilities
to serve their residents. In addition, a basketball arena and football field are provided for
the AAO program which serves youth.
Because Razorback Estates development is over 100 units, Ordinance 3793 regulates the Parks
Division to accept a land dedication. The ordinance states:
However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible
or advisable, it may recommend to thc City Council that a cash contribution pursuant to our ordinance be
accepted in lieu of land dedication. The City Council will eithcr accept the recommendation for a cash
contribution or return the subdivision plat to thc Parks Board with instructions or for further study.
Please review this request to waive the park land dedication requirement and to accept money in
lieu as the park land ordinance requirement for Razorback Estates. The required $68,400 park
land fee may be used for acquisition and development of park land that serves the development
within the northwest park district. These funds must be expended within three calendar years of
the last date of the calendar year in which it was received. If you have any questions concerning
