A RESOLUTION WAIVING ORDINANCE NO. 3793 AND
ACCEPTING MONEY IN LIEU OF GREENSPACE
REQUIREMENT FOR STONEGATE SUBDIVISION.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1 That the City Council hereby waives Ordinance No. 3793 and accepts moncy
in Iicu of greenspacc requirement for Stonegate Subdivision in the amount of $19,125.

SUBJECT: Waiver of the Park Land Dedication Ordinance 3793

Stonegate is a proposed subdivision located west of Highway 265 and south of Mission
Boulevard with 51 single family units on 40.18 acres. It lies south of the Boardwalk subdivision.
The owner of the subdivision is Mark Foster and the engineer is Jorgensen and Associates. The
requirement for park land is 1.2 acres and money in lieu is $19,125. Park staff toured the site
with David Jorgensen and recommended money in lieu be accepted as the requirement. The plat
was brought before the Parks and Recreation Advisory Board on January 12, 1999 to determine
the park land requirement.
The Parks and Recreation Advisory Board also recommended to accept money in lieu as the park
land requirement for the reasons stated below:
The close proximity of the subdivision to 41 acres of existing park land including
Root School Park 2 acres, Ridgeway 6 acres, Vandergriff School Park 8 acres,
Crossover Park 20 acres, and Happy Hollow School Park 5 acres.
The small size of the proposed 1.2 acre park land. There appears to be no land
available adjacent to this subdivision to be purchased in order to increase the park
acreage.
High maintenance cost of the small partial of land.
There are large lots in this subdivision which would be close to the size of the
proposed park. Usually we see a higher density of lots on subdivisions with this
acreage.
Slope of the land would make the park costly to develop and inadequate for many
activities.
The small acreage would not adequately serve this subdivision and surrounding
neighborhoods.
Park staff and Parks and Recreation Advisory Board agreed to continue searching for a larger
partial of land more conducive for park purposes in this vicinity. It is the opinion of the Parks
and Recreation staff that future acquisition of park land be directed toward large partials of land
rather than small partials that serve only a few and are associated with high maintenance cost.
Because the Stonegate subdivision is over 40 acres, Ordinance 3793 regulates the Parks Division

to accept a land dedication. The ordinance states:
However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible
or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be
accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash
contribution or return thc subdivision plat to thc Parks Board with instructions or for further study.
In 1996, the Parks and Recreation Advisory Board reviewed this same subdivision proposal called
Marvin Gardens and recommended to accept money in lieu of a land requirement. Please review
this request to waive the park land dedication requirement and to accept money in lieu as the
green space requirement for Stonegate. If you have questions concerning our requests to waive
