A RESOLUTION ACCEPTING THE RECOMMENDATION OF
THE PARKS AND RECREATION ADVISORY BOARD TO
ALLOW A WAIVER FROM THE PARK LAND DEDICATION
ORDINANCE TO ACCEPT MONEY IN LIEU OF PARK LAND
DEDICATION FOR THE SUMMIT SUBDIVISION LOCATED
SOUTH OF HIGHWAY 16 WEST AND WEST OF SHILOH
DRIVE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS -
Section 1 That the City Council hereby accepts the recommendation of the Parks and
Recreation Advisory Board to allow a waiver from the park land dedication ordinance to accept
money in lieu of park dedication for the Summit Subdivision located south of Highway 16 West and
west of Shiloh Drive.

SUBJECT: Waiver of the Park Land Dedication Ordinance 3793
A new subdivision that is not currently named, is proposed south of Highway 16 West and west of
Shiloh Drive. The subdivision consists of 108 multi -family units that sits on 9.28 acres. The
owner and developer is Summit Development and the engineer is Sand Creek Engineering and
Landscape Architecture Incorporated.
The requirement for park land is 2.16 acres and money in lieu is $40,500. The actual total amount
of acres or money in lieu will be determined during the final plat process in which the total number
of lots are determined. The formula base is updated every two years. A letter was received from
Summit Development, Inc. requesting consideration of a cash payment in lieu of a land dedication.
(See attached letter.) Park staff toured the site with the engineer Stephen Kramer and
recommended money in lieu be accepted as the requirement.
The Parks and Recreation Advisory Board held a special meeting on December 1, 1999 at the
proposed site. (See meeting minutes.) The board recommended to accept money in lieu as the
park land requirement based on the reasons stated below:
1. It is in close proximity to Ozark View Park which was selected as the future site for
the Youth Center. Plans of the Youth Center are to expand the acreage to about 20
acres.
2. It is a higher priority to use the money to develop a walking trail from the existing
subdivisions to the future Youth Center in Ozark View Park.
3. There was limited access from existing roadways to the proposed park within the
subdivision. The subdivision is also located in close proximity to the Interstate 540,
which would be a safety concern.
4. The developer proposed to provide several park amenities including a swimming
pool, basketball court, tennis court, recreation building, picnic tables and grills, and
an open park area for their residents.

Because the proposed subdivision contains over 100 units, Ordinance 3793 regulates the Parks
Division to accept a land dedication. The ordinance states:
However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible
or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be
accepted in Lieu of land dedication. The City Council will either accept the recommendation for a cash
contribution or return the subdivision plat to the Parks Board with instructions or for further study.
Please review this request to waive the park land dedication requirement and to accept money in
lieu as the park land dedication requirement for this development. If you have questions, please

SPECIAL MEETING
DECEMBER 1, 1999
A special Parks and Recreation Advisory Board meeting was held December 1, 1999. The Parks and Recreation
Advisory Board visited an unnamed development south of Highway 16 on Shiloh Drive. The purpose of the meeting
was to visit the development to consider for park land or money in lieu of the Park Land Ordinance.
Members Present: Alexander, Colwell, Eads, Luttrell, Shoulders, Stockland
Members Absent: Ackerman

Staff Recommendation: Money in Lieu. This will require a waiver to the Park Land Dedication
Ordinance since it contains over 100 units. It is in close proximity of Ozark
View Park, which was selected as the site for the future Youth Center. The
development has included a swimming pool, basketball court, tennis court,
recreation building, picnic tables and grills, and an open park area.
Mrs. Theil stated that the apartment complex could prevent access to others not living in the apartments from using
the amenities.
Mr. Schuldt stated that yes, the apartment could refuse access to the amenities for non residents.
Mrs. Theil stated that others in this area wouldn't have a park.
Mr. Schuldt stated that the Fayetteville Youth Center has a proposed site and there are other surrounding parks in
the area.
Mr. Luttrell stated that Ozark Electric is discussing a road that would go through from Shiloh Drive towards Ozark
Electric and beyond, thus, making easier access to Fayetteville Youth Centers proposed site.
Mr. Gulley said the new proposed Fayetteville Youth Center site would have many amenities.

Mrs. Theil recommended to earmark money for a trail along the boundary that Mr. Luttrell had discussed.
Mr. Luttrell stated that there had been a discussion with Mr. Marinoni, the land owner to the south and he is
receptive to the idea of the road.
Mr. Schuldt said if we do put in a park and the complex provides amenities it would be hard for people to distinguish
which is an amenity and which is a park.
Mr. Alexander stated he didn't see the feasibility of placing a park in a apartment complex.
Mrs. Theil said that her concern was the neighbors in adjoining subdivisions, however if other parks are accessible
that's okay.
Mr. Luttrell said he was concerned with people walking through residents yards to get to the park in the new
subdivision.
Mrs. Edmonston complimented the developer for providing the various park amenities for the residents.
Motion: Mr. Alexander motioned to take money in lieu of land, based on its close proximity to Ozark View and
possibly Fayetteville Youth Center.
Mr. Luttrell seconded the motion.
Motion passed 7-0.

Money in Lieu. It is located close to Gordon Long Park and the land dedication
is only .425 acres. The development is not linked to the park and contains Skull
creek which is in the flood way.
Mr. Schuldt stated staff visited the site to see it if Gordon Long could connect with the proposed land. Staff request
money in lieu of land based on the fact that we cannot connect the land with Gordon Long. There is also a steep area
and a creek running through the proposed land.

Mr. Gulley said the creek was Skull Creek.
Mrs. Theil said that Gordon Long is the only park in this area.
Mr. Gulley stated yes, but these apartments over here also have amenities. He also stated that Drake Road will be
cutting through the park and area
Mrs. Eads said we need more park land eventually, but not this land.
Mr. Alexander stated not .425 acres
Mrs. Theil said this is a small amount of land. Greenspace wouldn't be good, not in this area, not this piece of land.
Mr. Gulley stated that the area near the creek would be in the floodway and that there is already a walking trail
proposed in this area.
Mr. Shuldt stated he had visited with Chuck Rutherford and that a trail on the west side on the creek would be better.
Mr. Alexander said we have been discussing getting a large amount of land in the area.
Motion: Wade Colwell motioned for money in lieu of land.
Mr. Stockland seconded the motion.
Motion passed 7-0.
Parks and Recreation Advisory Board meeting for Monday December 6, 1999 is at 5:30 p.m. Holiday snacks will
be provided at 5:00 p.m.
