BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS• Section 1 That the City Council hereby approves lease modifications for the four car rental agencies currently serving the Fayetteville Municipal Airport/Drake Field; and authorizes the Mayor and City Clerk to execute said agreements. O. Box 2899, Little Rock, Arkansas 72203-2899 (Telephone 501-376-9151), hereinafter called "Lessee". WHEREAS, Lessor and Lessee entered into a Lease Agreement dated November 1, 1993• and, WHEREAS, the parties desire to modify the aforesaid Lease Agreement. NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS: 1. Number 1 of said Lease is hereby modified to read: Lessor hereby leases to Lessee and Lessee hereby hires and takes from the Lessor for the purpose herein enumerated, premises and facilities consisting of a Car Rental Booth and Manager's Office Space, located in the Fayetteville Municipal Airport Terminal Building, as shown in the Terminal Building plat attached hereto, marked Exhibit "A", consisting of two hundred and forty (240) square feet, more or less 2 Number 4, first paragraph, of said Lease is hereby modified to read: COMPENSATION TO LESSOR: Lessee agrees to pay Lessor as rental for use of the premises leased to it hereunder, and for the rights and privileges herein granted by the Lessor, ten percent (10%) of monthly gross receipts. Number 4, seventh paragraph, ADJUSTMENT OF MINIMUM ANNUAL GUARANTEE, is hereby deleted. 4. Number 12 of said Lease is hereby modified to read: TERM: The term of this agreement shall commence on the 1" day of February, 1999, and terminate on the 31" day of January 2000 unless sooner terminated for breach of the provisions hereof; provided, should any of the four existing car rental agencies at the Airport cease operation, this Lease shall terminate immediately and a new lease shall be negotiated. 5. All provisions of the Lease are incorporated herein and are hereby modified to conform herewith but in all other respects the provisions of the Lease, dated November 1, 1993 shall remain in full force and effect unless specifically changed hereby.
