A RESOLUTION APPROVING LEASE MODIFICATIONS FOR
THE FOUR CAR RENTAL AGENCIES CURRENTLY SERVING
THE FAYETTEVILLE MUNICIPAL AIRPORT/DRAKE FIELD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS•
Section 1 That the City Council hereby approves lease modifications for the four car
rental agencies currently serving the Fayetteville Municipal Airport/Drake Field; and authorizes the
Mayor and City Clerk to execute said agreements. A copy of the agreements arc attached hereto
marked Exhibit "A" and made a part hereof.

MODIFICATION OF LEASE AGREEMENT
EXHIBIT A
This AGREEMENT is made this day of �� 1999
by and between the City of Fayetteville, Arkansas, hereinafter called "Lessor", with Baker Car
and Truck Rental / dba Avis of P. O. Box 2899, Little Rock, Arkansas 72203-2899 (Telephone
501-376-9151), hereinafter called "Lessee".
WHEREAS, Lessor and Lessee entered into a Lease Agreement dated November 1, 1993•
and,
WHEREAS, the parties desire to modify the aforesaid Lease Agreement.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. Number 1 of said Lease is hereby modified to read:
Lessor hereby leases to Lessee and Lessee hereby hires and takes from the Lessor for the
purpose herein enumerated, premises and facilities consisting of a Car Rental Booth and
Manager's Office Space, located in the Fayetteville Municipal Airport Terminal Building,
as shown in the Terminal Building plat attached hereto, marked Exhibit "A", consisting
of two hundred and forty (240) square feet, more or less

COMPENSATION TO LESSOR: Lessee agrees to pay Lessor as rental for use of the
premises leased to it hereunder, and for the rights and privileges herein granted by the
Lessor, ten percent (10%) of monthly gross receipts. Furthermore, concessionaire shall
collect this ten percent (I0%) fee, to be paid to Lessor, by adding the fee as a separate line
item charge on the rental agreement. Such fee shall be titled, "Concession Fee" on each

1,500 a month, all car rental leases will be subject to renegotiation. Paved space parking
rate will be $10.07 per space per month plus overflow parking area at a rate of $43.11 per

3. Number 4, seventh paragraph, ADJUSTMENT OF MINIMUM ANNUAL
GUARANTEE, is hereby deleted.
4. Number 12 of said Lease is hereby modified to read:
TERM: The term of this agreement shall commence on the 1" day of February, 1999, and
terminate on the 31" day of January 2000 unless sooner terminated for breach of the
provisions hereof; provided, should any of the four existing car rental agencies at the
Airport cease operation, this Lease shall terminate immediately and a new lease shall be
negotiated.
5. All provisions of the Lease are incorporated herein and are hereby modified to conform
herewith but in all other respects the provisions of the Lease, dated November 1, 1993
shall remain in full force and effect unless specifically changed hereby.

between the City of Fayetteville, Arkansas, hereinafter called "Lessor", with National Car Rental
of Jones Olds , P. O. Box 4156, Fayetteville, Arkansas 72702 (Telephone 501-521-7281),
hereinafter called "Lessee".
WH ERE AS, Lessor and Lessee entered into a Lease Agreement dated November 1, 1993
and,
WHEREAS, the parties desire to modify thc aforesaid Lease Agreement.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. Number 1 of said Lease is hereby modified to read:
Lessor hereby leases to Lessee and Lessee hereby hires and takes from the Lessor for the
purpose herein enumerated, premises and facilities consisting of a Car Rental Booth and
Manager's Office Space, located in the Fayetteville Municipal Airport Terminal Building,
as shown in the Terminal Building plat attached hereto, marked Exhibit "A", consisting
of two hundred and forty (240) square feet, more or less.

WHEREAS, the parties desire to modify the aforesaid Lease Agreement.

WHEREAS, the parties desire to modify the aforesaid Lease Agreement.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:

WITH ALL FOUR CAR RENTAL AGENCIES SERVING DRAKE FIELD
Request review, approval and the signatures of the Mayor and City Clerk for the Modification of Lease Agreements
with all four car rental agencies currently serving Fayetteville Municipal Airport/Drake Field. This Modification
will eliminate the minimum annual guarantee of 545,000.00 a year per car rental agency. The airport will collect
10% of the monthly gross receipts of each car rental agency instead of the current 5%rate. Rates for the paved
parking ($10.07 per space per month) and overflow parking (S43.1 I per month) will remain the same.
Upon approval, this Modification will begin on February I, 1999 and terminate on January 31, 2000. All car rental
leases will be subject to renegotiation if any of the existing four car rental agencies at the airport cease operation
or if monthly deplanemcnts decline to less than 1,500 a month.
The Airport Advisory Board has approved this Agreement at their January 7, 1999 meeting.

10% of the monthly gross receipts of each car rental agency instead of the current 5%rate. Rates for the paved parking
($10.07 per space per month) and overflow parking ($43.11 per month) will remain the same. Upon approval, this
Modification will begin on February 1, 1999 and terminate on January 31, 2000. All car rental leases will be subject to
renegotiation if any of the existing four car rental agencies at the airport cease operation or if monthly deplanemcnts decline
to less than 1,500 a month. The Airport Advisory Board has approved this Agreement at their January 7, 1999 meeting.
