RESOLUTION NO R-99
A RESOLUTION CONCURRING WITH THE AHTD BID
AWARD TO MOBLEY CONSTRUCTION, INC. IN THE
AMOUNT OF $2,880,042.40 IN CONNECTION WITH THE
WIDENING OF HIGHWAY 16 WEST; AND APPROVING A
BUDGET ADJUSTMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS.
Section 1 That the City Council hereby concurs with the AHTD bid award to Mobley
Construction, Inc. in the amount of $2,880,042.40 in connection with the widening of Highway 16
West and the cost share agreement (See: Resolution 120-98) with AHTD. A copy of the cost share
tabulation is attached hereto marked Exhibit "A" and made a part hereof.
Section 2 The City hereby approves a budget adjustment increasing Highway 16 West
Widening, Acct. No. 4470 9470 5809 00, Project No. 95071 20, in the amount of $956,107 and
Highway 265 Water/Sewer Relocation, Acct. No. 5400 5600 5808 00, Project No. 97043 20, in the
amount of $700,000 by decreasing Highway 265 Water/Sewer Relocation, Acct. No. 4470 9470
5808 00, Project No. 97043 20, in the amount of $700,000; Sidewalk Improvements, Acct. No. 4470
9470 5814 00, Project No. 96041 1, in the amount of $125,000; Use of Fund Balance, Acct. No.
4470 0947 4999 99, in the amount of $131,107; and Use of Fund Balance, Acct. No. 5400 0940
4999 99, in the amount of $700,000. A copy of the budget adjustment is attached hereto and made
a part hereof.

Subject: Highway 16 West Bids
Attached is a letter from the Arkansas State Highway and Transportation Department
informing the City of the costs involved in the widening of Highway 16 West from
Highway 71 west to Ruplc Road. The AHTD opened bids on the improvements on
January 6, 1999. Mobley Contractors, Inc. of Morrilton, Arkansas submitted the low bid
of $2,880,424.01. McClinton -Anchor was the only other bidder on the job with a bid in
excess of S3,000,000.00.
In 1997 the City entered into an agreement with the Highway Department to pay for
one-half of the cost of the improvements to Highway 16 (Resolution 120-97, attached). In
accordance with that agreement, the City' estimated share of costs for the project is:

The City previously put up a deposit of S50,000 00, therefore the amount due to the
Highway Department at this time is $1.773,106.01.

The project involves the widening of Highway 16 for a distance of 5900 feet, from the
Highway 71 Bypass to Meadowlands Dnve with a transition section extending west of
Meadowlands Drive for about 200 feet. There are turn lanes at both Meadowlands Drive
and Ruplc Road and a 5 lane section of road from the Sports Park (west of Salem Road)
to Highway 71. The balance of the road will be 4 lanes
The 1999 Capital Improvements Program has S817,000 budgeted for this project. This
leaves a balance of 5956,106 to be obtained from other sourccs. Attached is a budget
adjustment in the amount of 5956,107.00 to cover the unfunded portion of the project.
It is the recommendation of the Staff that the Council approve a resolution concurring in
the Highway Department's award of the bid to Mobley Construction, Inc. in the amount
of 52,880,424 01 and approving the necessary budget adjustment.

A RESOLUTION AUTHORIZING THE CITY OF
FAYETTEVILLE TO ENTER INTO A 50/50 COST SHARING
AGREEMENT WITH THE ARKANSAS STATE HIGHWAY AND
TRANSPORTATION DEPARTMENT FOR THE WIDENING OF
AN APPROXIMATELY ONE MILE SECTION OF STATE
HIGHWAY 16 LOCATED WEST OF U.S. HIGHWAY 71.
WHEREAS, the Arkansas State Highway & Transportation Department has contacted the
City of Fayeneville regarding the widening of State Highway 16 from U.S. Highway 71 west to the
vicinity of Meadowlands Drive, a distance of approximately one mile; and,
WHEREAS, the widening of State Highway 16 is contingent upon a 50/50 cost sharing
agreement with the City of Fayetteville; and,
WHEREAS, the Ctty of Fayetteville is agreeable to share the costs of widening Highway
16 upon a 50/50 basis.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1 That the Mayor is authorized to enter into a 50/50 cost sharing agreement with
the Arkansas State Highway and Transportation Department for the widening of State Highway 16

Justification of this Increase:
ht 1998 the City committed to cost sham the cost of

with the Arkansas State Highway and Transportation
Department (AHTD). The AHTD opened bids and the
City cost is 5773,106.01 above the estimated cost. Additionally,
the City has received the 1998 rebate check from Beaver
Water District providing the funds to pay for the HWY 265
Water & Sewer Relocation from Water & Sewer Fund.
Justification of this Decrease:
The 1999 Budget split the funding for the HWY 265 Water &
Sewer Relocation between Sales Tax Capital Improvement
Fund and Water & Sewer Fund. The City received it's rebate
check from Beaver Water District and it is for enough money to
enable the City to shift the HWY 265 project to the Water &
Sewer Fund. Sidewalk improvements along HWY 16 West are
estimated at approximately 5250,000 with the City responsible for
50% or 5125,000. Finally, Use of Fund Balance is proposed for
