RESOLUTION NO 4 4 - 9 8
A RESOLUTION WAIVING THE REQUIREMENTS FOR
GREENSPACE FEES AND ACCEPTING 1.53 ACRES AND
$31,000 IN LIEU OF LAND DONATION FOR THE DINERSTEIN
APARTMENT COMPLEX.
WHEREAS, the Parks and Recreation Advisory Board met in a special session on March 12,
1998 regarding the Dinerstein greenspace issue; and
WHEREAS, the Advisory Board has determined that the 1.53 acres is currently the location
of the "Children's House"; and
WHEREAS, the Advisory Board has also determined that according to the 1994 Parks
Master Plan, this area is not listed as a "Priority" area for park land acquisition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby acknowledges the Parks and Recreation Board's
recommendation and accepts the 1.53 acres and $31,000 in lieu of land donation. A copy of the
legal description is attached hereto marked Exhibit "A" and made a part hereof. A deed to the 1.53
acres will be provided to the City by the developers upon closing of the Dinerstein property sale.

the Northwest Quarter (NW%) of the Northeast Quarter (NE%) of said Section 291
thence South 2°32'30" West - 736.92 feet, thence North 87°22'57" West - 545.98 feet
to the POINT OF BEGINNING, thence North 2°3703" East - 175.00 feet; thence North
87°22'57" West - 357.13 feet to the East Right of Way line of Arkansas Highway 265;
thence along said East Right of Way line South 8°47'50" West - 23.54 feet; thence
South 17°19'40" West - 77.48 feet; thence South 26°19'33" West - 83.72 feet; thence
leaving said East Right of Way line South 87°22'57" East - 413.00 feet to the POINT
OF BEGINNING, containing 1.53 acres, more or less, to the City of Fayetteville,
