HomeMy WebLinkAbout157-98 RESOLUTIONin it • RESOLUTION NO 15 7 - 9 8 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE HUMANE SOCIETY OF THE OZARKS TO PROVIDE A LOW INCOME SPAY/NEUTER PROGRAM ON A COST SHARE BASIS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1 That the City Council hereby authorizes the Mayor and City Clerk to execute an agreement with the Humane Society of the Ozarks to provide a low income spay/neuter program on a cost share basis . By red Hanna, Mayor • the ab • AGREEMENT FOR LOW INCOME SPAY/NEUTER PROGRAM COST SHARE This AGREEMENT executed this / day of Pt,/ enzg0e., 1998, between the City of Fayetteville, Arkansas, hereinafter called the "City" and Humane Society of the Ozarks, whose address is 103 North College, Suite #4, Fayetteville, AR 72703, hereinafter called "HSO", witnesseth: Whereas; the City has constructed an animal clinic to perform required cat and dog spay/neuter procedures for all cats and dogs adopted from the City of Fayetteville Animal Shelter; and, and, Whereas; the City has capacity to perform additional cat and dog spay/neuter procedures; Whereas; the HSO desires to implement a low income spay/neuter program. Now, Therefore, IN CONSIDERATION OF THE FOLLOWING COVENANTS and other considerations contained herein, the parties agree: 1) the HSO shall provide funding for the low income spay/neuter program. The initial year's funding is established at $31,000. (See attachment A) Funding requirements for future years shall be based on the most recent, completed prior year's actual expenses reduced by the fees collected during the prior year from the HSO Low Income Spay/Neuter Program Participant 2) the HSO shall deposit funds with the City at the beginning of each calendar quarter, for that calendar quarter, to fully fund the additional veterinary services and associated surgical supplies. 3) the HSO shall certify individual eligibility for participation in the low income spay/neuter program. 4) the City agrees to provide animal clinic space and the necessary building operating expenses. 5) the City agrees to collect and escrow the fees assessed by the HSO from the low income spay/neuter program participant. The collected fees shall be utilized to offset HSO future cost of the Low Income Spay/Neuter Program. 6) the City agrees to offer and perform the following additional services to the low income spay/neuter program participant after the appropriate fees have been paid to the City by the low income spay/neuter program participant: Occult heart worm test for dogs Leukemia test for cats Feline Leukemia vaccination for cats • • 1 7) the City agrees to offer and perform spay/neuter procedures inconjunction with the HSO Melissa Henderson Spay/Neuter Program 8) the City shall have the right to terminate this Agreement upon ninety days written notice to the HSO, and HSO shall have the right to terminate this Agreement upon ninety days wntten notice to the City. 9) Nothing in this agreement shall be construed to give any rights or benefits to anyone other than HSO and City.
