RESOLUTION NO. 98-96
A RESOLUTION APPROVING AMENDMENT NO. 1 IN THE
AMOUNT OF $4,500 TO THE MCGOODWIN, WILLIAMS
AND YATES, INC. ENGINEERING CONTRACT FOR THE 18"
FORCEMAIN REPLACEMENT PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby approves Amendment No. 1 in the amount
of $4,500 to the McGoodwin, Williams and Yates, Inc. engineering contract for the 18"
forcemain replacement project. A copy of the contract amendment is attached hereto marked
Exhibit "A" and made a part hereof.

AMENDMENT NO. 1 TO
AGREEMENT FOR ENGINEERING SERVICES
REPLACEMENT OF SEWER FORCE MAIN
CITY OF FAYETTEVILLE, ARKANSAS
WHEREAS, on August 21, 1995, the City of Fayetteville, Arkansas (Owner),
and the engineering firm of McGoodwin, Williams and Yates, Inc. (Engineer), entered
into an agreement to provide for engineering services in connection with replacement
of certain sections of 18" sewer force main; and
WHEREAS, this Agreement provided for a maximum fee of $7,500 for
construction management services, and
WHEREAS, the time required for construction and the level of effort required
on the part of the Engineer were greater than anticipated;
NOW THEREFORE, in consideration of the mutual covenants and agreements
herein contained, the Owner and the Engineer, the parties hereto, stipulate and
agree that the "Agreement for Engineering Services - "Replacement of Sewer Force
Main," dated August 21, 1995, is hereby amended in the following particulars.
Section III, "Payment," is amended to provide that the not -to -exceed fee
for construction services under Paragraph III -C be increased by $4,500
to cover additional hours required due to the extended construction
period and changes concerning installation of the existing 36" water line
and fire hydrant leads, additional meetings with OMI, the contractor, and
city staff on bypass pumping and hauling of sewage during tie-in
operations, retesting of failed pressure tests, and contractor claims for
extra costs for additional pumping during the tie-in paralleling Mud
Creek. Thus, the total estimated fee for construction services is
$12,000.
All other provisions of the original contract remain in full force and effect.

IN WITNESS WHEREOF, the Owner has caused these presents to be
executed in its behalf by its duly authorized representatives, and the said Engineer
by its duly authorized representatives, and the parties hereto have set their hands
