Rose City Attorney 113 West Mountain Fayetteville, Arkansas 72701 Dear Mr. Rose: Telephone: (501) 662-2007 This is in response to your request for my approval of a proposed "Interlocal Cooperation Agreement" to be entered into between the cities of Fayetteville and Johnson under the provisions of A.C.A. §§ 25-20-101 to -108 (Rept. 1992 and Supp. 1995) The purpose of the Agreement is to secure the improvement of a bridge near the two cities. The Agreement is in proper form and compatible with the laws of Arkansas. It is hereby approved. Attorney General WB:ECW/cyh 200 Tower Building, 323 Center Street • Little Rock, Arkansas 72201-2610 • • INTERLOCAL COOPERATION AGREEMENT BETWEEN THE CITY OF FAYETTEVILLE AND THE CITY OF JOHNSON This Agreement is made between the City Arkansas and the City of Johnson, Arkansas, subdivisions of the State of Arkansas under the 430 of 1967, codified at A.C.A.§25-20-102 et seq. known as the "Interlocal Cooperation Act" on the August , 1996. WITNESSETH: of Fayetteville, both political authority of Act (Repl. 1992) and 30th day of WHEREAS, the City of Fayetteville, Arkansas (Fayetteville) has plans in the near future to extend Joyce Boulevard to Wilkerson Street located in the City of Johnson (Johnson)in an effort to improve ingress and egress to the Northwest Arkansas Mall and surrounding commercial areas; and, WHEREAS, the Northwest Arkansas Mall and surrounding commercial areas constitute a regional shopping and commercial area influencing not only the needs and development of Fayetteville but also the entire Northwest Arkansas area including the City of Johnson; and, WHEREAS, the extension of Joyce Boulevard to Wilkerson Street will increase significantly the amount of traffic both north and south on Wilkerson; and, WHEREAS, there currently exists a one -lane bridge on Wilkerson north of the proposed intersection with Joyce Boulevard crossing Clear Creek (Bridge No. 19630) that is inadequate for the increase in traffic on Wilkerson Street; and, WHEREAS, Wilkerson Street is a part of the Arkansas highway system; and, WHEREAS, the City of Johnson and the State of Arkansas Highway & Transportation Department have entered into an Agreement of Understanding dated 29 August 1995 (attached hereto) in which the City of Johnson shall pay 20% of the costs of improving Bridge No. 19630 and 80% shall be provided by Federal -aid funds; and, • • Page 2 Interlocal Agreement City of Fayetteville City of Johnson WHEREAS, Fayetteville recognizes the importance to its citizens in improving Bridge No. 19630 for the transportation needs of its citizen, for the economic benefit its citizens will derive from improving access to the regional shopping and commercial area located within its boundaries and for the general benefit to be derived from controlling the development of such area; and, WHEREAS, Johnson has been asked by the AHTD by letter dated January 17, 1996 (attached) to pay $25,000 in order to proceed with the preliminary engineering of the improvement to Bridge No. 19630, said amount to be applied to Johnson's 20% matching share when the construction contract is awarded for the bridge project; and, WHEREAS, Fayetteville wishes to join with and assist Johnson in the improvement of Bridge No. 19630; and, WHEREAS, it is in both cities' mutual advantage to enter into a cooperative agreement to provide sufficient funds for the improvements to Bridge No. 19630. NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein and other good and valuable consideration the parties agree as follows: ARTICLE I There shall be created a joint board consisting of the respective mayors (or their representatives) of the City of Fayetteville and the City of Johnson, whose purpose shall be to oversee the payment of $25,000 to the AHTD for preliminary engineering on the Clear Creek Bridge (Bridge No. 19630) improvement project and to ensure that said payment will be applied as matching share at such time as a construction contract is awarded for such project. ARTICLE II The City of Fayetteville agrees to pay $20,000 as its share of the $25,000 requested by the AHTD for preliminary engineering on Bridge No. 19630 Project and the City of Johnson agrees to pay $5,000 as its share. Payment shall be at the time and in the manner agreed to by the Joint Board. • • Page 3 Interlocal Agreement City of Fayetteville City of Johnson ARTICLE III Should any portion or all of the monies paid by the parties under the terms of this agreement be refunded to either of the parties such refund will be divided between Fayetteville and Johnson on a pro rata basis according to the amounts paid by each. ARTICLE IV This Agreement shall expire upon the proper payment and allocation of the funds mentioned herein. This agreement may be extended or amended to allow for further cooperation between the parties regarding the Bridge No. 19630 Project by the approving vote of the city councils of each city. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby approves entering into an interlocal cooperative agreement with the City of Johnson for the expenditure of $20,000 as the City's share of cost for engineering services of a bridge replacement across Clear Creek. The cost does not include relocation and right of way costs. Section 2. That the City Council hereby approves a budget adjustment in the amount of $20,000 increasing Bridge & Drainage Improvements, Acct. No. 4470 9470 5817 00, Project No. 96104 by decreasing Use of Fund Balance, Acct. No. 4470 0970 4999 99. A copy of the budget adjustment is attached hereto and made a part hereof.
