RESOLUTION NO. 89-96
A RESOLUTION APPROVING PAYMENT IN THE AMOUNT
OF $26,000 TO JAMES E. AND NITA V LINDSEY AND
GILES A. AND ELSIE D. SEXTON, d/b/a PARADISE VALLEY
GOLF COURSE, FOR THE ACQUISITION OF 14,810 FT2
RIGHT OF WAY FOR IMPROVEMENTS TO JOYCE
BOULEVARD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby approves payment in the amount of $26,000,
to James E. and Nita V. Lindsey, and Giles A. and Elsie D. Sexton, d/b/a Paradise Valley Golf
Course, for the acquisition of 14,810 ft2 nght of way for improvements to the Joyce Boulevard
improvement project. A copy of the waarranty deed is attached hereto marked Exhibit "A" and
made a part hereof.
PASSED AND APPROVED this 6th day of August , 1996.

WARRANTY DEED
BE IT KNOWN BY THESE PRESENTS:

THAT James E. Lindsey and Nita V. Lindsey, husband
and wife, and Giles A. Sexton and Elsie D. Sexton, husband
and wife, and J. W. Reynolds Lumber Company, a Partnership,
hereinafter called GRANTORS, for and in consideration of the sum
of Ten Dollars (510.00) and other good and valuable consideration,
the receipt of which is hereby acknowledged, do hereby grant,
bargain, sell and convey unto the City of Fayetteville, Arkansas,
a municipal corporation, hereinafter called GRANTEE, and unto
Grantee's successors and assigns, the following described land,
situated in Washington County, State of Arkansas, to -wit:
Part of the South Half (S'h) of the Northeast Quarter (NEt/) of Section Twenty-
five (25), Township Seventeen (17) North, Range Thirty (30) West, Washington
County, Arkansas, more particularly described as follows: Commencing at the
Northwest corner of said S'Fe of the NE/a and running thence North 89 04' 24"
East 616.00 feet to the Point of Beginning; thence continuing North 89° 04' 24"
East 575.19 feet to the West line of Paradise Valley Subdivision Tract "8", as per
plat of said Subdivision on file in the records of the Office of the Circuit Clerk
and Ex -Officio Recorder of Washington County, Arkansas; thence South 01` 08'
11" East 25.08 feet; thence South 88 51' 49" West 503.85 feet; thence North 01°
08' 11" West 4.73 feet; thence South 89° 50' 27" West 72.18 feet; thence North
010 08' 11" East 21.22 feet to the Point of Beginning, containing 0.34 acre, more
or less.
TO HAVE AND TO HOLD the said lands and appurtenances thereunto belonging
unto the said Grantee and Grantee's successors and assigns, forever, And the said Grantors,
hereby covenant that they are lawfully seized of said lands and premises; that the same is
unencumbered, and that the Grantors will forever warrant and defend the title to the said
lands against all legal claims whatever.
And we, James E. Lindsey and Nita V. Lindsey and Giles A. Sexton and Elsie D. Sexton,
hereby release and relinquish unto the said Grantee our respective rights of dower/curtesy
and homestead in and to said lands.
