RESOLUTION NO. 83-96
A RESOLUTION ORDERING THE RAZING AND REMOVAL
OF AN UNSAFE STRUCTURE LOCATED AT 414 SOUTH
GOVERNMENT AVENUE.
WHEREAS, Alex Mahler and Lori Mahler are the owners of the real property described
m Exhibit "A" attached hereto and made a part hereof; and
WHEREAS, the City Council has determined that the structure located on said property
is dilapidated, unsightly, unsafe and detrimental to the public welfare; and
WHEREAS, the owners of said property, after having been given thirty days' notice by
certified mail, have neglected and refused to raze and remove said unsafe structure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That Alex and Lori Mahler are hereby ordered to raze and remove the
dilapidated, unsightly and unsafe structure located on the aforesaid real property Said work
shall be commenced within ten (10) days and shall be completed within thirty (30) days from the
passage of this resolution. The manner of removing said structure shall be: clear debris and
leave foundation, and haul all debris by truck to a landfill.
Section 2. If the aforesaid work is not commenced within 10 days or completed within
30 days, the Mayor is hereby directed to cause the aforesaid structure to be razed and removed;
and, the City of Fayetteville shall have a lien upon the aforesaid real property for the cost of
razing and removing said structure.

Tract 3
A part of Lots Four (4), Five (5) and Six (6) in Block Twenty-three (23) in
Ferguson's Addition to the City of Fayetteville, Arkansas, as per plat of said
Addition on file in the office of the Circuit Clerk and Ex -Officio Recorder of
Washington County, Arkansas, and a part of the Southeast quarter (SE'%) of the
Southwest quarter (SW %) of Section Sixteen (16) in Township Sixteen (16) North
of Range Thirty (30) West, described as follows, to -wit: Beginning 7 feet South
of the Northwest corner of Lot 4 in Block 23 in Ferguson's Addition to the City
of Fayetteville, Arkansas, thence West 50 feet or to the East line of Government
Avenue, thence South 113 feet or to the Northwest comer to the Joe West
property, thence East 140 feet, thence North 113 feet, thence West 90 feet to the
point of beginning, all located in the City of Fayetteville, Arkansas.
