A RESOLUTION REQUESTING THAT THE FOUR COUNTY
SOLID WASTE DISTRICT UTILIZE ALL AVAILABLE
RESOURCES TO DEFEND TI -IE REGULATIONS THAT
PROTECT BEAVER LAKE FROM POTENTIAL
ENVIRONMENTAL THREATS, SAID RESOURCES INCLUDE
ASKING THE ARKANSAS ATTORNEY GENERAL'S OFFICE
INTERVENE IN ANY AND ALL PROCEEDINGS, AS
APPROPRIATE, AND INVESTIGATE ALL ISSUES, AS
APPROPRIATE, RELATING TO PROPOSED, PLANNED,
PERMITTED OR POTENTIAL LANDFILLS ON, OR ABOUT,
HOBBS MOUNTAIN.
WHEREAS, by Resolution No. 41-96 the Fayetteville City Council has opposed the
establishment of a landfill site at the Hobbs Mountain site near Durham, Arkansas; and,
WHEREAS, the City Council wishes to protect the safety and well-being of its people
by examining potential threats to its sole and irreplaceable water supply, Beaver Lake; and,
WHEREAS, the City of Fayetteville addresses its solid waste issues through its
membership in the Four County Solid Waste District, which limits the environmental threats
associated with landfills by promulgating protective environmental regulations which protect our
regional water supply, Beaver Lake, including some landfill regulations now under attack in
court to strike them down; and,
WHEREAS, the City Council wishes the Four County Solid Waste District to utilize
all available resources including the Arkansas Attorney General's Office, if appropriate, to ensure
to its citizens the safety of the Beaver Lake water supply.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 That the City of Fayetteville hereby requests that the Four County Solid Waste
District utilize all available resources to defend the regulations that protect Beaver Lake from
potential environmental threats, said resources include asking the Arkansas Attorney General's
Office intervene in any and all proceedings, as appropriate, and investigate all issues, as
appropriate, relating to proposed, planned, permitted or potential landfills on, or about, Hobbs
Mountain.
