RESOLUTION NO. 43-96
A RESOLUTION APPROVING A HIGHWAY/UTILITY
CONTRUCTION/RELOCATION AGREEMENT WITH THE
ARKANSAS HIGHWAY TRANSPORTATION DEPARTMENT
FOR THE HIGHWAY 71 -GARLAND AVENUE WATER AND
SEWER RELOCATION.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
5ection 1. That the City Council hereby approves a Highway/Utility
Construction/Relocation Agreement, and authorizes the Mayor and City Clerk to execute same.
A copy of the agreement is attached hereto marked Exhibit "A" and made a part hereof.

E nclosed is your copy of the utility agreement approved on April 26, 1996, covering
reimbursement for the idjustment of your facilities on the referenced job.
This letter confirms the authorization given to you on September 29, 1995, to proceed
with advertising for bids. If you need additional right of way to accomplish your
adjustments, you may proceed with the acquisition of this right of way.
You are required to furnish a copy of each bid received and the bid tabulation sheet
for our review and concurrence. Should you elect to award the contract to other than
the low qualified bidder, the Department will participate only in the amount of the low
bid.
N o construction work should be performed until you receive a written work order from
this office. If I may be of assistance, please advise.

THIS AGREEMENT, made and entered into this it, day of n PR 1 1._ ,19%,by
and between the Arkansas State Highway Commission, acting by and through the duly authorized
representatives of the Arkansas State Highway and Transportation Department, with headquarters at Little
Rock, Arkansas, hereinafter referred to as the "Department," and the City of Fayetteville Water & Sewer
Department acting by and through its duly authorized representatives, hereinafter referred to as the "Owner"
WITNESSETH:
The Department proposes to make highway improvements as specified under the above
referenced job number and, the, "Owner" will adjust or relocate its existing facilities as set out in the
attached plans and cost estimate.
The Department will participate in the cost of said adjustment/relocation to the extent that
eligibility is hereinafter established
Payment will be made on an actual cost basis as mutually agreed between "Owner" and
"Department."
This agreement is governed by all applicable State and Federal laws, rules, and regulations
including the Arkansas State Highway Commission Utility Accommodation Policy adopted by
Commission Minute Order 89 455 as amended and supplemented, the Federal Aid Program Guide on
Utility Adjustments and Accommodation on Federal Aid Highway Projects as amended and
supplemented, and the provisions of 23 CFR § 645 as amended and supplemented.
DESCRIPTION OF WORK: Owner will clear construction by abandoning in place approximately
970 LF 12", 6,350 LF 8'; 210 LF 6", and 160 LF 2" waterlines, valves and fittings. Approximately
54 LF 12", 12,500 LE 8" and 200 LF 4" sanitary sewer lines will also be abandoned SerVICC will
be restored by the installation of approximately 986 LF 12; 6,447 LF 8", 226 LF 20 LF 4" and
171 LF 2" waterlines. Approximately 54 LF 12; 4283 LF 8", 240 LF 4" sewer lines will be
installed. The owner will also install approximately 4,302 LF 24"and 11 LF 16" waterline at no
cost to the Department. 18.9% of owners lines are presently located on private easement and
owner is eligible for reimbursement at that factor. A construction engineering cost of $80,000.00
has been included in the total amount Easement costs are not available and will be added later.
Work will be carried out by low bid contract.
The Department agrees that the required adjustment is 18.9% eligible for reimbursement for
the actual cost which is estimated to be $1,087,444.00 of which $205,587.44 to be paid by the
Department and $884857.56 is to be borne by Owner.
Owner will not commence work until authorized by the Department, and will then endeavor to
begin within 15 calendar days and complete within 240 calendar days thereafter
On completion of said work, "Owner" is responsible for the cleanup and restoration of the
work area including the disposal of surplus materials and debris.
Final billing must include all supporting detail. "Owner" shall also submit one (I) set of "as -
built" drawings at this time.
Payment will be 100% of lump sum bills and 90% of actual cost bills, final 1096 being released
on completion of Departments audit.
Expenses incurred under an actual cost agreement may be billed to the Department monthly in
increments of $5,000.00 or more.
"Owner" must maintain cost records and accounts to support the agreed adjustment/relocation
work. Said recorcls to be retained and available for inspection for a period of three (3) years from date
of final payment.
"Owner" shall be responsible for any and all hazards to persons, property, and traffic.
With respect to traffic control, owner shall adhere to the requirements of the 'Manual of
Uniform Traffic Control Devices", as amended and supplemented.
Owner shall save the Arkansas State Highway Commission, its officers, the Department, its
officers and employees harmless in all circumstances.
Notwithstanding anything hereinbefore written, neither the "Owner" nor the "Department" by
execution of this Agreement waives or relinquishes any rights which either may legally have within the
limits of the Law or Constitution, either State or Federal.

Following is a description of the water and sewer relocation costs which should be reimbursed
to the City of Fayetteville. These work items are referenced to the AHTD project stationing. I
have also enclosed one project manual, 5 sets of plans, and one copy of the quantity takeoff work
sheet including an estimate of the reimbursable costs. All relocations meet City and State
minimum practices for potable water systems and fire protection systems.
