RESOLUTION NO. 41-96
A RESOLUTION SUPPORTING THE APPEAL OF THE HOBBS
MOUNTAIN LANDFILL PERMIT AND OPPOSING THE
ESTABLISHMENT OF A LANDFILL SITE AT THAT
LOCATION.
WHEREAS, Sunray Services, Inc. has received a permit from the Arkansas Department
of Pollution Control & Ecology, hereinafter called ADPC&E, for the construction of a landfill
at the Hobbs Mountain site near Durham, Arkansas; and,
WHEREAS, an appeal has been lodged before the ADPC&E challenging the issuance
of such permit; and,
WHEREAS, there is an unjustified risk that leaks from the proposed landfill may
contaminate the White River and Beaver Lake; and,
WHEREAS, the City of Fayetteville has an overriding responsibility to its citizens in
protecting Beaver Lake as our irreplaceable and sole water supply resource vital to the basic
health and prosperity of our citizens, and,
WHEREAS, the City Council of the City of Fayetteville believes it is in the best interests
of our citizens to oppose the construction of a landfill at the Hobbs Mountain Site near Durham,
Arkansas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. The City Council hereby opposes the establishment of a landfill site at the
Hobbs Mountain site near Durham, Arkansas and expresses its support of the appeal to reverse
the ADPC&E decision granting a landfill permit to that site.
Section 2. The City Clerk of the City of Fayetteville is hereby requested to send a
copy of this resolution to the ADPC&E.
