RESOLUTION NO. 27-96

A RESOLUTION AWARDING BID NO. 96-08 IN THE
AMOUNT OF $168,000 TO HARRISON DAVIS
CONSTRUCTION CO., FOR THE CONSTRUCTION OF A 13
UNIT SINGLE ENGINE AIRCRAFT STORAGE UNIT AT
DRAKE FIELD.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. The City Council hereby awards Bid No. 96-08 in the amount of $168,000
to Harrison Davis Construction Co., for the construction of a 13 unit single engine aircraft
storage unit at Drake Field, and authorizes the Mayor and City Clerk to execute the contract
agreement A copy of the bid tabulation and contract are attached hereto marked Exhibit "A"
and made a part hereof.

EXHIBIT A
1. THIS CONTRACT AND AGREEMENT, made and entered into this
5fA day of M4r04 199‘, by and between the City of
Fayetteville, Arkansas, Party of the First Part, acting through
it's duly authorized representative, and
Harrison Davis Const. Co., Inc.

Party of the Second Part:
WITNESSETH:
That for and in consideration of the payments to be made as
hereinafter set forth, the Party of the Second Part hereby agrees
to furnish all tools, labor, equipment, materials and supplies
required to the furnished and to construct the improvements
designated as
South East T -Hangar Construction
for the City of Fayetteville, Arkansas, in exact accordance with
the Plans on file at the Office of the City Engineer, and
Specifications, Proposals, Stipulations, and Special Provisions
attached hereto and made a part hereof as fully as though copied
herein, under the direction of and to the entire satisfaction of
the Party of the First Part and in accordance with the laws of the
State of Arkansas.
2. It is further agreed and understood by and between the
parties hereunto that the Party of the First Part agrees to pay and
the Party of the Second Part agrees to accept as full and final
compensation for all work done under this agreement, the Unit
Prices and/or Lump Sum Price named in the Proposal which is hereto
attached, such payment to be made in lawful money of the United
States, at the time and in the manner set forth in the
Specifications.
3. The Party of the Second Part agrees, for the consideration
above expressed, to begin and complete the work within the time
specified in the Proposal. Time is expressly made of the essence
of this Contract. If the Party of the Second Part shall fail to
complete the work in the time specified he shall pay to the Party
of the First Part, as liquidated damages, ascertained and agreed,
and not in the nature of a penalty, the amount specified in the
Proposal for each day delayed, for each Schedule delayed, which
shall be deducted from the final amount to be paid under the
Contract. Extensions of time may be granted with waiver of
liquidated damages as provided for in the Specifications.

4. The Party of the Second Part agrees to furnish a Bond,
with an approved Surety thereon, guaranteeing the performance of
this Contract, as required by the laws of the State of Arkansas,
and for not less than one hundred (100) percent of the amount of
this Contract. Said Bond shall be conditioned on full and complete
performance of this Contract and acceptance by the City of
Fayetteville for the payment of all labor and materials entering
into or incident to the proposed improvements and shall guarantee
the work against faulty workmanship or materials for a period of
one (1) year after completion. The Surety on said Bond shall be a
Surety Company of financial resource satisfactory to the Party of
the First Part, and authorized to do business in the State of
Arkansas.
5. The Party of the second Part agrees also to carry Public
Liability Insurance, Property Damage Insurance, and Workman's
Compensation Insurance in amounts as required by these
Specifications.

ACTION REQUIRED: Request review and approval of Change Order #1 to a contract with Harrison Davis
Construction Co. for T -Hangar Construction. The change will modify the construction to accoihedate a
prospective T -Hangar tennent Charles Caldwell. Mr. Caldwell will make payment to the City for $2,475.00.
This change will allow an odd shaped aircraft to fit into the hangar. The change order also asks for 21 days
to be added to the contract to cover time lost due to this change.

LETTER OF AGREEMENT

This Letter of Agreement, by and between the City of Fayetteville Municipal Airport and
Mr. Charles Caldwell is for the purpose of specifying payment responsibility for a modification
to a T -Hangar unit to be constructed at Drake Field.
A modification to the unit D T -Hangar has been requested by Mr. Caldwell to
accommodate a specialized aircraft which he will store in the new T -Hangar. It has been
determined that this modification is of no benefit to the City, therefore, the cost of the said
modification will be borne at the sole expense of Mr. Caldwell.
It is hereby agreed to by both parties that the sum of $2,475 for the modifications
requested by Mr. Caldwell will be paid by Mr. Caldwell directly to the contractor, Harrison
Davis Construction, Inc. of Fayetteville Arkansas.
It is further understood that the City of Fayetteville shall not reimburse any sum to Mr.
Caldwell should he fail to lease said T -Hangar nor shall any payment be made upon termination
of any lease entered into by both parties.
Said modifications shall remain vested to the City upon construction.

Our cost to change unit # 1 and the adjoining storage, all at the South
end of New T -Hanger Building, (attached Drawing CO -1), to accept the 'Canard'
or Experimental Aircraft, is as follows:
MATERIALS, LABOR, EQUIPMENT AND ALL AS PER QUOTED: $ 2,475.00
Please execute documents to reflect the above changes in the Contract Work and
the Contract Amount.
We also request 21 days extension time, for time spent and to be used for
delay on release of materials for fabrication.
