A RFSOIIITION APPROVING A SUPPLEMENTAL
AGREEMENT TO THE ENGINEERING SERVICES
CONTRACT WITH DEVELOPMENT CONSULTANTS, L.L.C.
ENGINEERING, IN THE AMOUNT OF $4,940.00.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE.., ARKANSAS:
Section I. The Council hereby approves a supplemental agreement, in the amount of
54,940.00. for engineering services with Development Consultants, L L C Engineering, and
authorizing the Mayor and City Clerk to execute same. A copy of the amendment is attached
hereto marked Exhibit "A" and made a part hereof.

FIRST AMENDMENT TO
SUPPLEMENTAL AGREEMENT FOR ENGINEERING SERVICES
JOYCE BLVD AT U.S. HWY. 71B
FAYETTEVILLE, ARKANSAS
THIS FIRST AMENDMENT to the SUPPLEMENTAL AGREEMENT FOR ENGINEERING
SERVICES, is made and entered into by and between the City of Fayetteville, Arkansas,
hereinafter called the "OWNER" and Development Consultants, L.I. C., hereinafter called the
'ENGINEER" a corporation existing under the laws of the State of Arkansas. with principal
offices at 1970 East Joyce Boulevard. Suite 1, Fayetteville, Arkansas 72703,
WITNESSETH
WHEREAS, the OWNER and the ENGINEER entered into a Supplemental Agreement
for Engineering Services for inspection services (Title I1 Services) at the intersection of Joyce
Boulevard and U.S Highway 71B on March 7, 1995, and
WHEREAS, it is the desire of the parties to amend said contract by including additional
services to the scope of work to be performed by the ENGINEER, and by the modification of the
contract to reflect the additional expense required to perform said additional items
NOW, THEREFORE, for an in consideration of the terms, conditions, and covenants
hereinafter set forth, the parties hereto do mutually agree as follows
I. Modify SECTION II -- SUPPLENIEN1 AL SERVICES to include the following
additional item under the heading "Engineer to furnish the following:"
6 Construction drawings to be implemented into existing construction documents in
order to allow an additional left turn lane for south bound traffic U S liwy. 71B.
This design being to AASHTO standards and coordinated with the designated
traffic consultant.
H. Replace Paragraph 1, SECTION VI -- SUPPLEMENTAL. FEES AND PAYMENTS with
the following
For and in consideration of the services to be rendered by the engineer, the owner agrees to pay
and the engineer agrees to accept a fixed fee for all TITLE I1 SERVICES, in an amount of three
thousand four hundred fifty-seven dollars and seventeen cents (S3,457 17) . The total estimated
costs for TITLE II SERVICES. including fixed fees shall not exceed twenty-six thousand nine
hundred four dollars and ninety-four cents ($26.904.94). All miscellaneous expendable supplies
normally required by the engineer in the performance of these services will be purchased by the
engineer, who will be reimbursed by the owner as a reimbursable expense. Adjustment of the fee
may be made, should the engineer establish, and the owner agree, that there has been or is to be a
significant change in the:
(1) Scope, complexity, or character of the services to be performed
(2) Condition under which the work is required to be performed;
(3) Duration of work, if the change from the time period specified in the agreement for
completion of work warrants such adjustment.
11I. The effectne date of this Amendment is the date it is fully executed by the parties hereto
