'A RESOLUTION APPROVING AN ENGINEERING
CONTRACT WITH CH2M HILL FOR ENGINEERING
SERVICES FOR PHASE I OF THE MASTER DRAINAGE
'STUDY AND PLAN, AND APPROVAL OF A BUDGET
ADJUSTMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Council hereby approves a engineering contract with CH2M Hill
for engineering services for Phase 1 of the master drainage study and plan. A copy of the
contract is attached hereto -marked Exhibit "A" and made a part hereof
Section 2. The Council hereby approves a budget adjustment decreasing Bridge &
Drainage Improvements, Acct No. 4470 947015817 00, Project No. 94006 in the amount of
$50,000.00 to:increase Professional Services, Acct. No. 4470 9470 5314 00, Project No. 94006
in the amount'of $50,000.00. A copy of the budget adjustment is attached hereto and made a
part hereof. '. j

9. Limitation of Liability
CH2M HILL agrees to deferid, indemnify, andhold harrnless, the
CLIENT from and against liability claimsan causes of action,

in connection with the sole negligence orwillful misconduct of
omissions of CH2M ILL indirect connection with this project. No
clause shall be constructed in any form or manner to waive that
Tort Immunity as set, forth under Arkansas State Law.

10. Severability and Survival
If any of the provisions contained in this AGREEMENT are held
illegal, invalid or unenforceable, the enforceability of the remaining
provisions shall not be impaired thereby. Limitations of liability
indemnities, and other express representations shall survive
termination of this AGREEMENT for any cause.

12. Loan Monitoring Services
When CH2M HILL is providing PROJECT review and/or
construction monitoring services to lenders, CLIENT (Lender) will,
to the maximum extent permitted by law, indemnify CH2M HILL
from all claims, damages, losses, and expenses, including litigation
costs and attorney's fees, arising out of or relating to CH2M HILL's
involvement or presence on or near the PROJECT.

; that belong to the borrower(s), developer(s), construction
contractor(s), designer(s), testing laboratory(ies); full-time
inspector(s), or other parties associated with the PROJECT not
in the employ of or a subcontractor to CH2M HILL.
13: Interpretation
The limitations of liability and . indemnities will apply whether
CH2M HILL's liability arises under breach of contract or warranty;
tort, including negligence; strict liability; statutory liability; or any
other cause of action, except the limitations will not apply to willful
misconduct or gross negligence for limitations of liability or sole
negligence for indemnification. Said limitations shall apply to
CH2M HILL's officers, affiliated corporations, employees, and
subcontractors.
The law of the State of Arkansas shall govern the validity of this
AGREEMENT, its interpretation and performance, and any other
claims related to it.
14. No Third Party Beneficiaries
This AGREEMENT gives no rights or benefits to anyone other
than CLIENT and CH2M HILL and has no third party
beneficiaries. CH2M HILL services are defined solely by this
AGREEMENT, and. not by any other contract or agreement that
may be associated with the Project
15. Materials and Samples
Any items, substances, materials, or samples removed from the
PROJECT site for testing, analysis, or other evaluation will be
returned to the PROJECT site within 60 days of PROJECT
close-out unless agreed to otherwise. CLIENT recognizes and
agrees that CH2M HILL is acting as a bailee and at no time
assumes title to said items, substances, materials, or samples.
16. Assignments
This is a bilateral personal services AGREEMENT. Neither party
shall have the power to or will assign any of the duties or rights or
any claim arising out of or related to this AGREEMENT, whether
arising in tort, contract or otherwise, without the written consent
of the other party. Any unauthorized assignment is void and
unenforceable. These conditions and the entire AGREEMENT
are binding on the heirs, successors, and assigns of the parties
hereto.
Services covered by this AGREEMENT will be performed in accordance with the Provisions stated on the back of this form and any
attachments or schedules. This AGREEMENT supersedes all prior agreements and understandings and may only be changed by written
amendment executed by both parties.

Fayetteville Master Drainage Plan
Scope of Services
Task 1. Citywide Stormwater Master Plan Strategy and System Mapping
A. Strategy Meeting
A stormwater master plan strategy meeting workshop will be conducted where the
goals and objectives of a Citywide program are defined. Basin studies will be
priontized from high to low based on existing floodmg problems and potential
problems likely to occur as a result of rapid basin development. A program
implementation time line will be developed which will identify basin master
planning efforts on an annual basis. A coordination meeting will then be held with
the U.S. Army Corps of Engineers and the Federal Emergency Management
Agency (FEMA) to discuss their upcoming work efforts related to the FEMA
Floodplain Update. A coordinated effort will be outlined in order to maximize ,the
two study efforts.
Citywide Stormwater Master Plan Guidance
CH2M HILL will prepare a Technical Memorandum (TM) that summarizes the
conclusions and recommendations of the strategy meeting, and meeting with the
U.S. Army Corps of Engineers and FEMA. This TM will serve as the guidance
document for successfully completing a Citywide stormwater master planning
program.
C Mapping Workshop
CH2M HILL will conduct a mapping workshop directed at identifying and
recommendmg a map development methodology that will allow for the smooth
translation of AutoCAD drawing files, ortho/digital photometric mapping,
contours, and planimetrics to a GIS platform. A TM will be produced
documenting conclusions and recommendations of the workshop.
1. The following topics will be discussed at the workshop:
a. Existing City capabilities
b. Future graphics/GIS needs

2. A TM will be produced by CH2M HILL that will summarize existing
capabilities, future needs, and program costs (budgetary) required to satisfy
future needs, and an implementation strategy.
Map Development
CH2M HILL will review storm sewer record drawings and as -built drawings
provided by the City and map existing storm sewers 36 -inches and larger.
The graphics platform used to generate storm sewer mapping will be
AutoCAD (Release 12).
Ortho/digital photographs developed by Aenal Data Service, under a
separate contract with the City of Fayetteville, will be used as base
mapping.
3. Review existing aerial photography.
4. Determine if additional photography and topography is required to cover
` the study area and contributing drainage areas.
a. Advise City of need for additional photography and topography.
Coordinate obtaining additional photography and topography with
subconsultant or current City consultant. Determine if this effort is
to be a part of this contract.
5. Base mapping will illustrate contours, channels, rivers, buildings, streets,
and attributes associated the these planimetrics Overlays to the base map
will include the following:
a. Watershed boundaries
Storm sewer system (dosed and open channel) 36 inches and
larger.
6. The City will prioritize and authorize system mapping on a watershed by
watershed basis as funding allows.

Task 2.1 Inventory Existing Structures and Systems
Subbasin Delineation
Define minimum size of subbasins to delineate and modeled. This will
establish the upper tributary study limits Study limits will be defined by a
storm sewer system's inability to convey the 100 -year flood in the
curb/gutter (subject capacity limitations defined in the Drainage Criteria
Manual) and storm sewer, requiring a closed or open system designed to
convey the 100 -year flood.
Develop basin and subbasin boundary mapping.
B. Existing Structures and Systems Survey
1. The City will authorize existing structures and systems survey on a
watershed -by -watershed basis as funding allows.
2. Define existing structures and systems to be surveyed and included m the
model for the study, such as, structures 36 inch in diameter and larger
located along the main stem and tnbutaries of the drainage basins and
subbasins
3. Conduct field reconnaissance to determine extent of field survey
requirements and develop channel condition factors.
4. Conduct field survey of existing structures to determine location, type, size,
elevations, and general condition including structural condition.
Photographs to be taken of all structures to be included in the model for
office reference.
5. Locate known high water marks and determme elevations.
6. Determine finish floor elevations of known structures that flood.
Benchmarks will be provided by the City.
7. While conducting field reconnaissance, the need for a structural evaluation
of a structure(s) will be identified. The need will be based on the
magnitude and nature of cracks, pitting, structural undermining, and
observed failure of inventoried structures. This effort will not require entry
into confined areas Structural evaluations will be performed by a
structural engineer and will be considered as an additional service to this
Scope of Work.

Severe areas of bank and bed erosion will be noted when conducting the
field reconnaissance.
9. Identify projects requiring immediate attention, allowing some constriction
of high priority projects to occur simultaneously to, but in conjunction
with, the study.
Existing System Workshop
1. Conduct workshop with City staffto discuss status of project and review
maintenance problems identified that need immediate attention.
2. Provide an itemized list of maintenance problems with channels and/or
structures observed during the field reconnaissance to the City to be
addressed while the study is being completed, in addition to known
problems

2. Structure inventory in tabular format notmg location, type, general
condition, and maintenance problems observed.

IT IS ANTICIPATED THAT ALL WORK DESCRIBED IN TASKS 3 THROUGH 8
WILL BE PERFORMED IN THE FUTURE AS FUNDS ALLOW AND AS
AUTHORIZED BY THE CITY OF FAYETTEvmLE.
Task 3. Hydrologic Analysis
A Develop Existing and Future Basin Development Conditions
1. Utilizing City land use and zoning information, basin and subbasin
development conditions will. be established and land use areas assigned
within each subbasin.
Runoff parameters will be established for each drainage area based on
existing and future development conditions.

Review existing information as follows:
1. City maintenance records of drainage structures and systems
2. Records of citizen complaints related to drainage issues
3. U.S. Army Corps of Engineers information
4. U.S. Geological Survey information

7. Stream gauge data
8. Regional regression equations
9. University of Arkansas information
C Hydrologic Modeling

1. U.S. Army Corps of Engineers HEC -1 Flood Hydrograph Package
computer software will be used for hydrology modeling.
2. Hydrologic models will incorporate drainage parameters for each subbasin
including:
a. Basin slope
b. Basin soil conditions
c. Impervious areas
d. Initial and constant losses
e. Travel time
3. Runoff hydrographs will be developed for each subbasin.
4. Runoff hydrographs from each subbasin will be combined at hydrologic
points and routed to the next downstream hydrologic point.
5. Hydrologic modeling will be performed for existing and fully developed
urbanized conditions.
6. Flood routing in channels and impoundments.
7. High-water information will be used for model verification, in adition to
additional field surveys.
8. Hydrologic modeling will be performed for the 10-, 25-, 50-, and 100 -year
storm frequencies for both existing and future (fully urbanized) conditions.

Task 4. Hydraulic Analysis
A. Hydraulic Model

1. Hydraulic modeling will be performed utilizing U.S. Army Corps of
Engineers HEC -2 Water Surface Profiles computer software.
Hydraulic modeling will be performed for the 10-, 25-, 50-, and 100 -year
storm frequencies.
3. Hydraulic modeling will be performed for existing and fiilly developed
urbanized conditions.
4. Cross sections of the open channels will be taken from the aerial digitized
topography for the hydraulic modeling where possible.
5. Supplementary field cross sections will be field surveyed where necessary
such as culverts and channel sections where required.
6. Water surface elevations generated by the computer model will be
compared to high-water information where available from pubhc records.
Floodplain Mapping
Develop floodplain maps indicating existing and future 100 -year floodplains based
on the computer-generated flood elevations.
Hydrologic and Hydraulic Modeling Workshop
Conduct workshop with City staff to review project status and hydrologic
and hydraulic modeling.
2. The workshop will be used as an opportunity to brainstorm possible
solutions for -problem areas. Task 6, Alternative Analysis, will investigate
the feasibility of implementmg two potential solutions.

b. Pnnclpal and 1\fmor Arterial—such as 50 -year
c. Collector—such as 25 -year
d. Residential—such as 10 -year
2. Determine drainage system improvement strategy related to the following
issues:
a. Stormwater detention
b. Purchase of floodplain areas (property evaluations are not included
in this Scope of Services)
B. Conceptual Alternatives
Determine conceptual potential alternatives for each problem area.
1. Document advantages and disadvantages of each potential alternative
without the use of modeling based on basin constraints and general
knowledge.
2. Present potential alternatives to City staff for discussion prior to modeling.
Conceptual Alternative Workshop
Conduct interactive workshop with City staff to discuss status of project and
potential alternatives considered.
Select alternative solutions that appear feasible for each problem area for modeling.

D. Alternative Analysis
Develop hydrologic and hydraulic models as appropriate for selected alternatives.
1. Incorporate selected altematives into models for all storm frequencies for
existing and fully urbanized basin conditions.

3. Refine alternatives if required to improve impact if possible.
4. Document impact of selected alternatives for existing and fully urbanized
condition.

for the
Fayetteville Master Drainage Plan Phase 1
The CITY OF FAYEI IEVILLE, ARKANSAS, as CLIENT, and CH2M HILL, as ENGINEER,
have entered into an AGREEMENT dated May 19, 1995, to furnish engineering services in
connectionIwith Phase 1 of the Fayetteville Master Drainage Plan.
The parties hereby agree that the following modifications will be added and modify the

1. Revise the Engineer's Fee Estimate to reflect a cost increase in Task 1—City-wide
Stormwater Master Plan Strategy and System Mapping by $20,000 resulting in a total
task amount of Forty-one Thousand, Forty-five Dollars ($41,045). CH2M HILL will
review storm sewer record drawings and as -built drawings provided by CLIENT and
map existing storm sewers 18 -inches (36 -inches and larger in original contract) and
larger.

Master Drainage Study and Plan Phase 1,
Engineering services contract with CH2MHILL.
The contract for Phase 1 of the Master Drainage Plan and Study was approved
by the City Council on 16 May 1995 in the amount of $79,392.00.
The scope of phase 1 includes:
The mapping of:
Watershed boundaries,
Basin and sub -basin delineation,
All storm sewers 36 inch in diameter and larger, culverts,
bridges and stream system.
Field surveys and reconnaissance as necessary to establish the
hydraulic models.
The proposed change order (amendment no. 1) will increase the mapping by
including all storm drainage from 18 inches in diameter and above. The
City has a relatively small amount of drainage 36 inches in diameter and
above. The additional information will be useful in the overall study and
to the City.
The scope of the subtask to field inventory existing structures and systems
can be reduced due to the changes in the overall Master Study Plan. The
Corps of Engineers and FEMA have offered, and committed, to participate in
the hydrologic and hyraulic studies for most of the existing conditions in
the City. CH2MHILL will still be required to analyze some existing
conditions and all of the future conditions for ultimate development and
provide a plan of required improvements.
The precise scopes for the Corps of Engineers and CH2MHILL have yet to be
determined. The Corps will take two or three years for their work.
CH2MHILL will use the Corps final models and revise for ultimate
•
development. This will take at least one additional year. Thus the
overall Master Plan and recommendations will be delayed until 1999 or 2000.

Storm Sewer System Mapping
Submitted for your consideration are proposed fee modifications to Task 1 City
Stormwater Master Plan Strategy and System Mapping of the Master Drainage Plan
Project. We have reviewed the storm sewer record drawings and topographic maps
provided by the City and have concluded that Task 1 fees are insufficient to
complete the mapping effort. We have estimated that Task 1 fees will increase
between $20,000 and $28,000, for a total task amount ranging between $41,000 and
$49,000.
As discussed at our meeting on Tuesday, January 23, 1996, CH2M HILL s mapping
deliverable will include the following.
• AutoCAD files of 18 -inch storm sewer and larger (generated from record
drawings furnished by the City)
• Line attributes will include size, pipe type, and slope
• Manhole attributes will include measure down dimensions to invert flow lines
CH2M HILL will complete Task 1 mapping efforts within 8 weeks after receiving
authorization to proceed. This
