HomeMy WebLinkAbout15-95 RESOLUTION• RESOLUTION NO. 15-95 A RESOLUTION AUTHORIZING THE WIDENING OF THE STREET TO 25 FEET AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT NO. 4 TO A CONTRACT WITH MILHOLLAND ENGINEERING FOR ENGINEERING SERVICES TO PROVIDE REVISIONS 1N THE DESIGN AND CONSTRUCTION MANAGEMENT OF THE IMPROVEMENTS TO STUBBLEFIELD ROAD. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby authorizes the widening of the street from 18-20 feet to a width of 25 feet in lieu of the standard residential 31 feet. Section 2. The City Council hereby authorizes the execution of Amendment No. 4 to the engineering contract with Milholland Engineering to provide for revisions in the design and construction management of the proposed improvements to Stubblefield Road. A copy of the contract amendment is attached hereto marked Exhibit A and made a part hereof. PASSED AND APPROVED this 7th day of February , 1995. APPROVED: By: Hanna, Mayor • • CONTRACT AMENDMENT NO. 4 FOR ENGINEERING SERVICES STUBBLEFIELD ROAD IMPROVEMENTS STA. 0+00 TO STA. 26+50.40 E-447 CONTRACT AMENDMENT NO. 4 FOR ENGINEERING SERVICES PROJECT: STUBBLEFIELD ROAD IMPROVEMENTS E-447 THE ORIGINAL CONTRACT was made and entered into on May 24, 1989, AND THIS CONTRACT AMENDMENT NO. 4, made and entered into .on this ly+h day of fcAn.a,y , 1995, by and between the City of Fayetteville, Arkansas, hereinafter referred to as the "OWNER", and Milholland Company, Engineering and Surveying, Consulting Engineers of Fayetteville, Arkansas, hereinafter referred to as the "ENGINEER", WITNESSED THAT: WHEREAS, the OWNER Originally desired to Construct STUBBLEFIELD ROAD 31 feet in width from HAROLD STREET North and East to Old Missouri Road centered in a Right -Of -Way fifty feet (5.0') in width, AND WHEREAS, the OWNER has AMENDED its desires several times, as depicted in previous AMENDMENTS, AND WHEREAS, the OWNER AMENDED its desires in Amendment No. 3 to Construct a portion of Stubblefield Road at 31 feet in width, as follows: PHASE II IMPROVEMENTS: FIRST CONSTRUCT THE EAST END OF STUBBLEFIELD ROAD FROM STA. 26+50.40 to the center of Old Missouri Road; II: RE -STAKE lost and/or obliterated control for Construction; WHEREAS, the OWNER has AMENDED its desires again to Re -Design and Construct the Balance of the Stubblefield Road Improvements, as follows: A. Re -Design Stubblefield Road, Street and Drainage Improvements, and appurtenances from Harold Street (STA. 0+00) to STA. 26+50.40; B. The Street Construction Centerline for the East/ West segment shall be three feet (3') North of the existing .Baseline located along the centerline of the fifty feet (50') Street Right -of -Way; C. Street section shall be reduced from 31' to 25' BACK-TO-BACK of Curbs'; D . Design a concrete sidewalk along the North side of East/West segment and East side of North/South segment of said Street; E . Design WATER MAIN Replacement from Summerhill Drive to Loxley Avenue; F. Re -Stake lost and/.or obliterated control for construction; Field locate and design of obstacles placed within PROJECT LIMITS since.O'RIGINAL plans were developed; H . Prepare additional Right -of -Way easements, as may be required; AND I. Estimate Construction Costs of Re -Design and provide for the Adjustment of Construction Bid to match funds budgeted for project. J Relocation of SWTBCO Cable along the North side of East/West segment. WHEREAS, the .OWNER deemed it essential to delay and modify its original plans, and Amend, AND WHEREAS, the ENGINEER has sufficient experienced personnel and equipment to perform the work described in this Agreement, as Amended, NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the OWNER and the ENGINEER, the parties hereto, stipulate and agree that the OWNER does hereby .employ the ENGINEER to perform the required engineering services as hereinabove set out; AND the ENGINEER agrees to provide said ADDITIONAL SERVICES. SECTION 1: DESCRIPTION OF PROJECT "AS AMENDED": The Project for which engineering services are to be provided are as follows: PROJECT No. 1 - PHASED CONSTRUCTION OF STUBBLEFIELD ROAD IMPROVEMENTS FROM HAROLD STREET NORTH AND EAST TO STA. 26+50.40 including, but not limited to, Street and Storm Drainage Construction, Water Main Replacement and Sidewalk Construction. PHASE I BEING FROM STA. 0+00 (.Harold Street) TO STA. 26+50.40; 2 The balance of SECTION 1 AND ALL OF SECTION 2 OF THE "ORIGINAL CONTRACT" AND CONTRACT AMENDMENT NO. 2 and NO. 3 shall remain unchanged. Amendment No. 4 shall be completed within twenty .(20) working days after Notice To Proceed of Approved Contract. SECTION 3. •COMPENSATION AS AMENDED: Compensation for the various types of services to be provided under this contract shall be made as 'follows: PROJECTS No. 1: STUBBLEFIELD ROAD IMPROVEMENTS: A. PART I: BASIC ENGINEERING SERVICES: (AMENDED) RE -DESIGN and DEVELOP PHASED CONSTRUCTION PLANS: Compensation for the Re -Design of Phase :I shall be a Lump Sum Fee of $8,700.00 in addition to the .Original Contract and Amendment No. 2 and No. 3, which states the following: Compensation for Basic Engineering Services shall be a LUMP SUM FEE amount of $26,500.00 FOR AMENDMENT NO. 3 INSTEAD OF CONTRACT AMENDED AMOUNT OF $11,000.00. This fee includes full compensation for Every item of work as described in SE.CTI.ON 2, PART I. The fee is based on an estimate of the various classifications of work at an hourly rate. The hourly rates include direct labor costs plus allowances for indirect labor costs, overhead and profit. B. PART I -A: RIGHT-OF-WAY ACQUISITION: Compensation for PLATS AND DESCRIPTIONS for Right -.df -Way Easements shall be based on the hours of work actually required. The hourly rates shall be based on charges for the various classifications of personnel identical to those set out under SECTION 3-F. "HOURLY RATE PER CLASSIFICATION". Only work as directed by the OWNER shall be done under this section of the contract. The AMENDED total fee shall not exceed $5;000.00 INSTEAD OF THE ORIGINAL CONTRACT AMOUNT OF $2,000.00 and CONTRACT AMENDMENT NO. 2 AMOUNT OF $3,200.00 and Amendment No. 3 amount of $3,800.00. C. PART II: BIDS THROUGH AWARD OF CONTRACT: (AMENDED) Compensation for "Advertisement for Bids" through "Award of Contract" for Amendment No. 4 shall be $1,000.00 per "CONSTRUCTION CONTRACT DOCUMENT" INSTEAD OF ORIGINAL CONTRACT amount of $400.00 and AMENDMENT NO. 2 amount of $600.00, AND AMENDMENT NO. 3 amount of $1,000.00. 3 D. PART III: CONSTRUCTION MANAGEMENT: Compensation for Construction Management Service described in SECTION 2, PART III, shall be as follows: PROJECT No. 1: STUBBLEFIELD ROAD: Compensation for CONSTRUCTION PHASE I shall be based on the hours of work actually required. The hourly rates shall be based on charges for the various classifications of personnel identical to those set out under SECTION 3-E. "HOURLY RATE PER CLASSIFICATION", with a MAXIMUM -NOT -TO -EXCEED $20,000.00 FOR AMENDMENT NO. 4 with a maximum construction time of 180 consecutive Calendar Days or less from date .of "NOTICE -TO - PROCEED•" to construction contractor; FUTURE CONSTRUCTION PHASES SHALL BE NEGOTIATED AT SUCH TIME SERVICES ARE TO BE PERFORMED.
