A RESOLUTION APPROVING AMENDMENT NO. 3 TO CEI,
INC.'S ENGINGEERING SERVICES CONTRACT, IN THE
AMOUNT OF $17,000 FOR JOYCE BOULEVARD EXTENSION
TO GREGG AVENUE AND APPROVING A BUDGET
ADJUSTMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. The Council hereby approves Amendment No. 3 to CEI, Inc. engineering
services agreement, in the amount of $17,000 for the Joyce Boulevard extension to Gregg
Avenue, and the Mayor and City Clerk are hereby authorized to execute said agreement. A copy
of the agreement is attached hereto marked Exhibit "A" and made a part hereof.
Section 2. The Council also approves a budget adjustment in the amount of $160,000
to increase Street Improvements, Acct. No. 4470 9470 5809 00, Project No. 94034 by
decreasing Payments by Property Owners, Acct. No. 4470 0947 4420 00. A copy of the budget
adjustment is attached hereto and made a part hereof.

ENGINEERING SERVICES AGREEMENT FOR
JOYCE BOULEVARD EXTENSION
FAYETTEVILLE, ARKANSAS
THIS THIRD AMENDMENT to the ENGINEERING SERVICES AGREEMENT is mads. and entered
into by and between the Cit) of Fayetteville, Arkansas. a municipal corporation, hereinafter referred to as
"CITY". and CEI Engineering Associates. Inc., hereinafter referred to as "ENGINEER".
WITNESSETH:
WHEREAS, the CITY and LNGINEER % lxcred into an Agreement !Or Engineering Servi.cs for
the extension of Joyce Boulevard to Wilkerson Street (Johnson, Arkansas) on February 14. 1995. and
WHEREAS, it is the desire of the parties to amend said contract by including additional services
to the Scope of Work to be performed by the ENGINEER. and by the modification of :he contract to
reflect the additional expense required to perform said additional items.
NOW, THEREFORE. for and in consideration of the terms, conditions. and covenants hereinafter
set forth. the parties hereto do mutually agree as follows:
I.
Mudd) Task 3 of Article IV SCOPE. OF WORK, to include revisions to construction plans and
hid documents.
Task 3 - Final Design
A 3:1 hackslope will be pro\ idcd within the NANCIIAR and Majorie Brooks property.
instead of the 2.5:1 slope currently shown on the plans.
Five lanes will be constructed hemeen STA 27+00 and STA 14+07. Four lanes with a
center median will be constructed between SIA 14+07 and STA 13 + .7.
One set of four six inch PVC conduits will be provided for utility crossings between STA
17 4-00 and STA 18+00. One set of four six inch PVC conduits will he provided between
STA 20+00 and STA 21-i 00
Two sixteen inch steel encasements will he provided as future sewer crossings. One will he
placed at STA 26+80 One crossing will he paced between STA 17 00 and STA 18+00.
The sewer crossings wil: he placed approximately seven feet deep at a slope of 0.4 rA slope,
with the highest side on the north side of the road.
One sixteen inch steel encasement will he provided between STA 20+00 and STA 21+00
for a future water crossing. This crossing will he provided approximately three feet deep.
Revise Right -of -Way on NANCHAR and Majorie Brooks property to eighty feet and show
a fifty foot temporary construction easement on NANCHAR & Majorie Brooks property.
II. Modify Article IX as shown below:
The following amounts shall he paid to ENGINEER for completing the respective Tasks outlined
above
Task 3 - Final Design Amendment to Contract $ 17.000.00
Task 3 - Final Design Total $ 59.540.00
111. Total modified fee shall not exceed One Hundred Forty Eight Thousand, Two Hundred Sixty
Dollars. ($148.260.00) without written authorization from the City
IV. The effective date of this Amendmen, is the date it is fully executed by the parties hereto.
IN WITNESS WHEREOF. the•parties have caused this contract to he executed in multiple copies by
the duly authorized representatives upon the dates se- forth immediately below.

JOYCE BOULEVARD EXTENSION
FAYETTEVILLE, ARKANSAS
TIIIS THIRD AMENDMENT to the ENGINEERING SERVICES AGREEMENT is made and entered
into by and between the City of Fayetteville. Arkansas. a municipal corporation, hereinafter referred to as
"C11'Y", and CEI Engineering Associates, Inc.. hereinafter referred to as "ENGINEER".

WHEREAS, the CITY and ENGINEER entered into an Agreement tar Engineering Services for
the extension of Joyce Boulevard to Wilkerson Street (Johnson, Arkansas) on February 14, 1995. and
WHEREAS, it is the desire of the parties to amend said contract by including additional services
