HomeMy WebLinkAbout14-95 RESOLUTIONRESOLUTION NO. 14-95 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE ORIGINAL CONTRACT WITH MCGOODWIN, WILLIAMS & YATES FOR THE ENGINEERING SERVICES ON THE TRANSFER STATION AND RECYCLING MATERIALS PROCESSING FACILITY BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby authorizes the execution of an amendment to the original contract with McGoodwin, Williams & Yates in the amount of $194,319.00 for engineering services on the Transfer Station and Recycling Materials Processing Facility. A copy of the contract is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 7th day of February , 1995. ATTEST: By: la Traci Paul, City Clerk APPROVE i By: Fred Hanna, Mayor EXHIBIT A AMENDMENT NO. 1 TO AGREEMENT FOR ENGINEERING SERVICES SOLID WASTE FACILITY CITY OF FAYETTEVILLE, ARKANSAS WHEREAS, on June 28, 1994, the City of Fayetteville, Arkansas (Owner), and the engineering firm of McGoodwin, Williams and Yates, Inc. (Engineer), entered into an agreement to provide for engineering services in connection with a Transfer Station and Recyclable Materials Processing Facility; and WHEREAS, the preliminary studies provided under the original agreement have been completed; and WHEREAS, the Owner is now ready to proceed with design and construction of the facilities; and WHEREAS, the original agreement provided that the amount and method of compensation for engineering services through detailed design and preparation of construction plans, bidding, and construction of the project would be negotiated after completion of the preliminary studies; and WHEREAS, it is now necessary to amend the original agreement to set out the method and amount of such compensation; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the Owner and the Engineer, the parties hereto, stipulate and agree that the "Agreement for Engineering Services - Solid Waste Facility" dated June 28, 1994, is hereby amended as follows. Section III, "Payment," is hereby amended to delete Paragraph "B" and substitute the following: 1. For detailed design and preparation of construction plans and specifications as set out in Section II -B, compensation to the Engineer shall be a lump sum fee of $105,800. This fee shall be payable in three monthly installments of $33,000 each and one final payment of $6,800, with the first payment to be due 30 days after authorization to proceed from the Owner. 2. For bidding and preconstruction services as set out in Section II -C, compensation to the Engineer shall be a lump sum fee of $6,180. This fee shall be due and payable when construction contracts are ready for execution. Fay #1 - 1 • • 3. For construction services as set out in Section II -D, compensation to the Engineer shall be paid on an hourly basis in accordance with the rates set out below plus reimbursable expenses. January 1. The Engineer agrees• to keep an accurate record of the hours of the various classifications of personnel working on the:project. Payment shall be made monthly and shall include :all costs accrued. Reimbursable expenses for which the Engineer will be reimbursed shall include travel expenses when traveling .outside Northwest Arkansas in connection with the project,:renta.l expenses for special equipment needed for completion of the work, purchase of material, permit lees, and other expenses directly attributable to the project„ including .any work performed by subcontractors.: The Engineer shall charge the owner for reimbursable expenses at actual cost plus ten percent (lo%).
