HomeMy WebLinkAbout144-95 RESOLUTION• RESOLUTION NO. 144-95 A RESOLUTION OPPOSING SITE DEVELOPMENT AND CONS iRUCTION AT THE PROPOSED HOBBS MOUNTAIN LANDFILL SITE PRIOR TO CULMINATION OF THE APPEAL PROCESS. WHEREAS, Sunray Services, Inc. has received a permit from the Arkansas Department of Pollution Control & Ecology, hereinafter called ADPC&E, for the construction of a landfill at the Hobbs Mountain site near Durham. Arkansas; and, WHEREAS, an appeal has been lodged before the ADPC&E challenging the issuance of such permit; and, WHEREAS, Sunray Services. Inc. has asked the ADPC&E to modify the stay of the landfill permit under appeal to allow site development and construction pnor to the appeal being heard; and, WHEREAS, the City Council of the City of Fayetteville believes it is in the best interests of fundamental fairness and the citizens of Fayetteville not to start construction until the appeal process has been completed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. l'he City Council of the City of Fayetteville hereby opposes the request of Sunray Services, Inc. to modify the stay of the landfill permit under appeal to allow site development and construction prior to the culmination of the appeal process before the ADPC&E. Section 2. The City Clerk of the City of Fayetteville is hereby requested to send a copy of this resolution to the ADPC&E to arrive prior to their scheduled hearing on this matter to he held on Friday, December 1, 1995 in Little Rock, Arkansas.
