A RESOLUTION ACCEPTING A GRAN r FOR YOUTH
ALCOHOL. ENFORCEMENT IN THE AMOUNT OF $27,000.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. The Council hereby accepts a grant for Youth Alcohol Enforcement in the
amount of $27,000 to he used to pay personnel overtime expense. A copy of the grant is
attached hereto marked Exhibit "A" and made a part hereof.

WORK STATEMENT
The contra:tor, Fayetteville Police Department, in exchange for
consideratinr offered ov the Arkansas State Highway and rrarspertation
Department 'AHTD), and the interest of improving traffic safety.
hereby agree, to pursue -he achievement of the following objectives:
1. Objective I: To achieve one DUI/DWI arrest for every eight hours of
selective enforcement_
a The contractor ar'1 appoint a Project Director who wil' be
responsible for eoordinatino selective DL'I_/DWI enforcement
activities and AC' as liaison with the Traffic Safety Sec -ion
(TSS'. Compensati^_r for the Pro'ect Director will be from local
fund:.
h The ?\ffense of dri•'-ng under the influence (DUI) shall be defined
as or.:urr'ng when a youth, urder the age of 21, is operating or in
actual physical cc'trol of a motor vehicle when at the time there
is one -fiftieth of ore percert (0.02%), but less than one-tenth of
one rercert r0.10t'. ov weight of alcohol in the persor s blood as
determined by a chemical test of the person's blood. breath or
^the' bodily subs-=nce.
c. The offerse of dri.'1rg while intoxicated (DWI) shall be defined as
occurring when ar individual is operating or in actual physical
contro' of a motor vehicle when at the time there is equal to or
greater than one-tenth of ore percent (0.10%), by weight of
alcoho- in the person's olcod or if they are under the influence
or affected by the ingestion of a controlled substance as
determined by a chemical test of the person's blood. breath or
other bodily subs-ance.
d. It shall be the responsibility of the contractor to ensure that,

WORK STATEMENT
P. :t sha'1 he the respors1bi1ity e` the contractor to schedule the
assicnment of ove-tire personnel during time periocs with the
greatest potentia for detecting impaired drivers to facilitate the
achievement of one ?JI/DWI arrest for every eight hours of overtime
selective enforcement and to extend the avai'ahility of `ands
throughout the entire contract period. Project officers will work
on an overtime basis that Coes not exceed one and one-half times
their regular hourly rate and for nc longer than eight bouts during
the 12 hour period from 6:O0 D.T. to 6:00 a.m.

Thursday evenings and wil' conc'Jde no later than 6:00 a.T. Sunday
mornings. Select' :el enforcement may be provided on other weekdays
during which State and/or National ho'ida_vs are being observed.

connectior with and being funded by this contract. Unless a bona
fide emergency arises. routine patrol `unctions. including accident
inve,tigaticn, wil' be assigned to those personnel cn requ'ar duty.
h. Should a project c`ficer becoTe involved it other routine patrol
funs«ions while on project overtime status, the officer shall
immediately go on requ'ar hours worsed or regular overtime statues.
2. Objective II: To reduce officer down time per DUI/DWI arrest to 90
minutes or less.

standardized fie'r sobriety testing, transporting the suspected

other traffic laws.

b. A Project Director's Summary Report (PDSR) will be submitted to
the TSS in accordance with formats which will be proviced by
NHTSA. This repot and the `final reimbursemert request are due
within 15 days fo'low'ng the erd of the contract period. sinal
payment will not. he made urtil a satisfactory FDSR is submitted.
Included with the PDSR will be a tabulation of local funds
contributed to this project.
c. The contractor will create a project file f maintaining the
contract and financial documents. The file wi'1 contain a cony of
this contract, cortract terms, related AHTD policies and
Procedures, policies and procedures of the contractor related to
this Project's act» 'ities. copies of monthly activity reports and
roimhjrsement requests, correspondence relating to the contract, a
copy pc daily worksheets and time sheets which reflect regular and
overtime hours worked and documentation of any public information
activities. The `file gust be maintained in one location and 's
subject to review State and rederal authorities responsible for
oversight of this rroject. Note: Copies of all time sheet; for
all 'overtime officers Paid through this contract must be kept in
this file.
