HomeMy WebLinkAbout11-95 RESOLUTION1 FAYETTEVILLE THE CITY OF FAYETTEVILLE, ARKANSAS • January 19, 1995 Traci Paul City Clerk City of Fayetteville Fayetteville, AR 72701 Dear Madam Clerk: Pursuant to my authority as Mayor of the City of Fayetteville, I hereby exercise the mayor's power to veto the following resolution passed by the City Council on January 17, 1995: RESOLUTION NO. 11 - 95 A RESOLUTION AMENDING SECTION VI -20, SUBSECTION (1)(a) OF THE CITY PERSONNEL POLICY AND SECTION VI -18, SUBSECTION (1)(a) OF THE CITY CIVIL SERVICE PERSONNEL POLICY TO ALLOW FOR THE RECOGNITION OF EMPLOYEE ORGANIZATIONS AS A SPOKESPERSON OF ANY GROUP OF EMPLOYEES. WHEREAS, the City of Fayetteville is barred from recognizing any employee organization as a spokesperson of any group of employees; and, WHEREAS, the City of Fayetteville should have the freedom and discretion to decide whether or not to recognize any employee organization as a spokesperson of any group of employees. NOW, THEREFORE, HE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That Section VI -20(1)(a) of the Personnel Policy of the City of Fayetteville is hereby repealed and the following shall be inserted in its place: Section VI -20 EMPLOYEE -EMPLOYER RELATIONS POLICY. 1. That Section VI -18(1)(a) of the Civil Service Personnel Policy of the City of Fayetteville is hereby repealed and the following shall be inserted in its place. PASSED AND APPROVED this 17th day of January APPROVED: By: Fred Hanna, Mayor ATTEST: By: Traci Paul, City Clerk In my judgment as Mayor of the City of Fayetteville, the resolution is contrary to the public interest of the citizens of Fayetteville because: 1. I consider it unnecessary as a correction of our current personnel policies, which I am convinced already allow employees and spokespersons for employees to talk to me, their superiors, the City Council and anyone else they wish. 2. I consider it the first step by the Fayetteville Firefighters' Association toward seeking union recognition in order to engage in collective bargaining with the City. 3. I believe the resolution could be construed as a recognition of the rights of certain special interest groups among City employees. This is wrong. The goals of special interest groups are not always consistent with the general good. It has already led to Page 3 Traci Paul, City Clerk January 19, 1995 a certain amount of divisiveness in employee ranks and is bound to lead to more. Please cause this exercise of the veto power of the mayor to be laid before the next regular meeting of the Fayetteville City Council as required by law.
