A RESOLUTION AWARDING A ENGINEERING CONTRACT
IN THE AMOUNT OF 552,347.00 WITH A CONTINGENCY
AMOUNT OF $5,235.00 TO DEVELOPMENT
CONSULTANTS, INC.: AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID CONTRACT; AND
APPROVAL OI' A BUDGET ADJIJSTMENT IN THE AMOUNT
OF $52,582.00.
BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 The City Council hereby awards a engineering contract in the amount of
552,347.00 with a contingency amount of $5,235.00 to Development Consultants, Inc., and
authorises the Mayor and City Clerk to execute said contract. A copy of the contract is attached
hereto marked Exhibit "A" and made a part hereof.
Section 2. The City Council hereby approves a budget adjustment increasing Bridge
& Dramagc Improvements, Acct. No. 4470 9470 5817 00, Project No. 93078 by decreasing
Street Improvements, Acct. No. 4470 9470 5809 00, Project No. 94034, in the amount of
S52,582.00. A copy of the budget adjustment is attached hereto and made a aprt hereof.

:ontract for the Mud Creek/Gregg Street Bridge. The bridge
project is a 80-20 !unclog formula with the AHTD. The 20%
+hare will be funded by the City and developers: The Rouse
Company and Clary Development. The cost share agreement has

proceeding with the bridge to coincide with completion of the

improvements is scheduled to occur during 1994 and 1995.
Replacement funds utilized for this requeat should be available from
the cost share agreements with the developers.

AGREEMENT FOR ENGINEERING SERVICES

THIS AGREEMENT, entered into and executed this " ,', day of
1994 by and between The City of Fayettevile
hereinafter called the "Owner", and Development Consultants,
L.L.C., a corporation existing under the laws of the
State of Arkansas, with principal offices at 1970 East Joyce
Boulevard, Suite 1, Fayetteville, Arkansas 72703,
hereinafter called the Engineer.
WITNESSETH:
WHEREAS, the Owner is reconstructing a certain bridge
replacement on a road in Fayetteville; and WHEREAS, the
Owner wishes
WHEREAS, the
to employ an Engineer to perform said work; and
Engineer's staff is adequate and well-qualified
and it has been determined that its current workload will
permit completion of the plans for the project on schedule;
NOW, THEREFORE, it is considered to be in the best public
interest for the Owner to obtain the assistance of the
Engineer's organization in connection with said engineering
services. In consideration of the faithful performance of
each Party of the mutual covenants and agreements set forth
hereinafter, it is mutually agreed as follows:

SECTION I -- EMPLOYMENT OF ENGINEER
The Owner agrees to employ the Engineer to perform, and
the Engineer agrees to perform, professional engineering
services in connection with the Project as set forth in the
Sections to follow; and the Owner agrees to pay, and the
Engineer agrees to accept, cost incurred plus fixed fee, as
specified in the Sections to follow, as full and final
compensation for work accomplished in the specified time.
SECTION III -- INFORMATION AND SERVICES
The project consists of developing plans &
specifications for construction of a new bridge with
approach work (ABTD Standards)for replacement of a current
bridge location, all within the City of Fayetteville,
Arkansas.
All public hearings and all environmental handling is
the responsibility of the Owner/AHTD.
The Owner will furnish the following:
1. Traffic projections.
2. Geotechnical information.
(boring locations to be determined by the
consultant in coordination with ABTD).
3. Preparation of environmental documentation.
4. Conduct public hearings.
5. Application for Department of the Army Section 404
permits as needed, utilizing information provided
by consultant (ABTD).
6. Right of way and utility handling coordination.

The Owner will be responsible for Utility Agreements. The
Owner will make available to the Engineer any Standards,
Design Criteria, Utility Policy, and other information in
its possession which relate to the Project for use by the
Engineer in the performance of the necessary engineering
services. Reproducible copies of current Arkansas State
Highway and Transportation Department Standard Drawings for
inclusion in the plans, if and as required, will be
furnished by AHTD. Copies of the Arkansas State Highway and
Transportation Department's Special Provisions will also be
furnished, as needed and as requested, to the Engineer by
AHTD.
SECTION IV -- SERVICES TO BE FURNISHED BY THE ENGINEER
(TITLE I SERVICES)
The project consist of the replacement of an existing
bridge structure. This structure is inadequate to handle
the publics needs and will be replaced with a new facility.
The bridge location is to be designed to standards
in accordance with the "AASHTO Bridge Specifications" and
the "AASHTO Policy on Geometric Design of Highways and
Streets, 1984". Specifications will be in conformance with
the latest edition of the Arkansas Standard Specifications
for Highway Commission and latest applicable Arkansas
Highway & Transportation Department Special Provisions.
The extent of bridging required will depend upon a
complete hydraulic study and geotechnical analysis.

Any information necessary for the satisfactory
preparation of the Final Plans and Job Special Provisions in
addition to that information furnished by the Owner shall be
prepared by the Engineer. The engineer shall perform the
following as a part of this project:
a. Preliminary Design & Layout
b. Soils Boring Coordination.
c. Hydraulic Analysis of Bridge Location.
d. Final Design & Layout.
e. Required Field Inspection during Design.
f. Required Mtgs. w/ City & AHTD.
g. Preparations for Quantities & Special Provisions.
SECTION V -- ENGINEER'S RESPONSIBILITY DURING CONSTRUCTION
(TITLE II SERVICES)
As the Construction Contracts are awarded and notice to
proceed is issued, the Engineer shall:
a. Check shop drawings as appropriate.
Title II Services in this Agreement are for
conventional construction.
SECTION VI -- CONSULTATION SERVICES DURING CONSTRUCTION
If, during the course of construction, consultation
between the Owner and the Engineer is required, the Owner
agrees to compensate the Engineer.
Payment will be made monthly upon presentation of
invoices prepared in the required form and number, subject
to the approval of the Owner.
SECTION VII -- SUBCONTRACTING
Subcontracting by the Engineer of any of the services
require prior approval by the Owner.

SECTION VIII -- TIME OF BEGINNING AND COMPLETION
The Engineer shall begin work under this Agreement
within ten (10) days of notice to proceed and shall complete
all TITLE I SERVICES by January 1, 1995.
The above completion time is predicated upon the fact
that the Owner/AHTD will cause to be processed approvals of
interim work in an expeditious manner.
SECTION IX -- FEES AND PAYMENTS
For and in consideration of the services to be rendered
by the Engineer, the Owner shall pay and the Engineer shall
receive reimbursement of all salary costs, overhead, and
fees at rates paid by the Engineer during the Contract
Period, consisting of TITLE I SERVICES, including the Fee of
Six Thousand Five Hundred Five Dollars and Eighty One Cents
($6,505.81) not to exceed an Upper Limit Contract amount of
Forty Nine Thousand Eight Hundred Seventy Seven Dollars and
Eighty Seven Cents ($49,877.87), plus reimbursable expenses,
and Title II Services, not to exceed an Upper Limit Contract
amount of Two Thousand Four Hundred Sixty Eight Dollars and
Sixty Four Cents ($2,468.64), plus reimbursable expenses.
Reimbursable expenses are for mileage, reproduction,
long distance telephone, production supplies, etc..
The basis of this upper limit and justification for the
fee is contained in Appendix "A", attached hereto.
Adjustment of the upper limit may be made, should the
Engineer establish and the Owner agree, that there has been
or is to be a significant change in the: (1) Scope,

complexity, or character of the services to be performed;
(2) condition under which the work is required to be
performed; (3) duration of work, if the change from the time
period specified in the Agreement for completion of work
warrants such adjustment.
TITLE II SERVICES shall be billed on a marked -up salary
based on the established SCHEDULE OF SALARY RANGES. The
mark-up shall include fee and the overhead rates
established. This mark-up will remain in effect unless
adjusted by a later audit and incorporated into a
Supplemental Agreement. The following schedule covers the
rate for each individual shown.

estimates of quantities, and the satisfactory completion of
any related services required by the Owner.
Final payment for TITLE II SERVICES shall be made upon
the Owner's approval, and upon the Engineer's satisfactory

1. Background . The City of Fayetteville entered into a contract for engineering services in the amount of
552,347 00, and a 10% project contingency of $5 235 was approved on November 4, 1994. After this
contract was approved, additional survey information was required for design purposes The Arkansas
Highway and Transportation Department performed the original survey, and DCI had to procure additional
information throughout the design process. Additional information was required to the north of the
project Information was also required due to a possible change in the alignment of the bridge.
2. Funding Approximately twenty percent of this engineering contract will be paid by developer funds
3. Staff Recommendation. The Staff recommends the approval of Change Order No 1 to the
engineering services agreement with Development Consultants, L.L.C. for the replacement of the Mudd
Creek bridge. The requested amount is within the approved protect contingency of $5,235.

As you know. we have had to provide additional survey services outside our original
scope for the above referenced project. At this time, we would like to request additional
funds for payment of these required services. The additional work is as follows:
1. Additional topographic and ownership data outside of original work
provided by AHTD for design
2. Additional alignment data necessary to provide information concerning
alignments to Phil McConnell. Reqwred in order to look at next project to the
north for bndge replacement
The total costs for these additional services was Three Thousand Five Hundred Ninety -
Nine Dollars and Sixty -Five Cents ($ 3,599.65). We are requesting that dollar amount
to be added to our maximum amount stated within our contract. If there are any

Development Consultants Inc has an engineenng contract with the City for this project. 'The
original contract had a not to exceed upper limit of $ 52,347 00 However, it did not include
provisions for right of way document preparation later, amendment to obtain survey
information was processed. This amendment brought the not to exceed limit of the contract to
$ 55,946 65.
To provide finding for right of may preparation. we are proposing amendment #2 to the
engineering contract. The original fixed fix fcc of $ 6.505.81 will he modified to $ 8.92(1.96. The
original upper limit contract of $ 55,946 65 ( including amendment art) will be modified to an
amount of $ 68,401.24

AGREEMENT FOR ENGINEERING SERVICES
MUDD CREEK BRIDGE
FAYETTEVILLE, ARKANSAS
THE AMENDMENT to the AGREEMENT FOR ENGINEERING SERVICES, is made
and entered into by and between the City of Fayetleville, Arkansas. hereinafter called
the "OWNER'. and Development Consultants, L.L.C., hereinafter called the
"ENGINEER" a corporation existing under the laws of the State of Arkansas, with
principal offices at 1970 East Joyce Boulevard, Suite 1, Fayetteville, Arkansas 72703,
WITNESSETH
WHEREAS. the OWNER and the ENGINEER entered into an Agreement for
Engineering Services for design services (Title I Services) at the Mudd Creek Bridge on
Gregg Street on November 4, 1994, and
WHEREAS. it is the desire of the parties to amend said contract by including
additional services to the scope of work to be performed by the ENGINEER, and by the
modification of the contract to reflect the additional expense required to perform said
additional items.
NOW, THEREFORE for an in consideration of the terms, conditions, and
covenants hereinafter set forth. the parties hereto do mutually agree as follows:
I. Modify SECTION IV — SERVICES TO BE FURNISHED BY THE ENGINEER to
include the following additional item as a part of this project:
h. Preparation of Right of Way documents. The documents being
to AHTD standards for acquisition.
II. Modify SECTION IX — FEES AND PAYMENTS with the following:
1. Replace existing Fee shown with the new amount of Eight Thousand
Nine Hundred Twenty Dollars and Ninety Six Cents ($8,920.96).
and
2. Replace existing Upper Limit Contract shown with the new amount of
Sixty Eight Thousand Four Hundred and One Dollars and Twenty Four
cents ($68,401.24), plus reimbursable expenses.
III. The effective date of this Amendment is the date it is fully executed by the
parties hereto.
IN WITNESS WHEREOF. the parties have caused this contract to be executed in
multiple copies by the duly authorized representatives upon the dales set forth
immediately below.
