HomeMy WebLinkAbout77-94 RESOLUTION• • • • • RESOLUTION NO. 77-94 A RESOLUTION ESTABLISHING THF FAYETTEVILLE SQUARE GARDENS ADVISORY BOARD. WHEREAS, the Fayetteville town square gardens are a source of civic pride to all the citizens of Fayetteville and; WHEREAS, the beauty of the town square gardens enhances the quality of life of the citizens of Fayetteville and is also a valuable asset in attracting visitors to our city and; WHEREAS it would assist the Mayor and City Council in managing this asset to have a group of individuals who arc knowledgeable in gardening, landscaping, and civic needs to advise them regarding matters pertaining to the town square gardens, its management and care. NOW THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section_l. There is hereby created a Board to be known as the Fayetteville Square Gardens Advisory Board whose purpose is to provide the Mayor and City Council with general and technical citizens input and assistance regarding the use and management of the Fayetteville Square Gardens. Section 2. Creation and Appointment. The Fayetteville Square Gardens Advisory Board shall consist of five members: a) One member of said board shall be a member in good standing of Downtown Fayetteville Unlimited nominated by that organization and confirmed by the ('ity Council. h) One member of said board shall he a member in good standing of the Farmer's Market Association nominated by that organization and confirmed by the City Council. c) Two members of said board shall be a citizen al large appointed by the City Council using the same methods of nomination and appointment as other city boards and commissions, with preference to be given to applicants belonging to organized gardening groups within the City. • Page 2 Resolution No. 77-94 • d) One member of said board shall be a city representative who may be a city employee appointed hy the Mayor and confirmed by the City Council. c) The member of the board appointed by the Mayor shall serve at the pleasure of the Mayor. All other members shall, when first appointed. serve for one (1), two (2), three (3). or four (4) years each as designated hy lot drawn to the presence of the City Clerk. All successive terms shall he for a period of live years. t) Any appointed board member may be removed at any time by a majority of the elected members of the City Council. g) The Adviscny Beard shall nominate by maionty vote an appropriate individual an the academic staff of the University of Arkansas to serve in a non-voting advisory capacity to the board on a yearly basis. The Fayetteville Square Gardens Advisory Board shall have the authority to advise the Mayor and City Council on the management. operation, improvement, extension and maintenance of the Fayetteville square gardens and its related properties, if any, under the supervision of the Mayor or his appointee: a) Proposed contracts, policies, procedures, revisions, deletions. additions or other issues related to the Fayetteville square gardens initiated hy the general public, the City Council or city staff should be referred to the Square Gardens Advisory Board prior to any action on such matter whenever possible or feasible. The Advisory Board shall consider all matters referred and shall submit a recommendation to the Mayor regarding such matter(s): b) The Fayetteville Square Gardens Advisory Board shall have the authonty to develop a suggested work program and operating budget for the square gardens and submit such suggestions to the Mayor; c) Recommendations of the Advisory Board are not final. All decisions of the board are subject to final consideration by the Mayor or City Council as appropriate or required by resolution. ordinance or statute; Page 3 Resolution No. 7 7 - 9 4 d) The Advisory Board may adopt any rules, regulations, or procedures necessary for the purposes stated herein and not in conflict with this ordinance.
