If that is not an option, please allow this offer to preserve an irreplaceab'e historic resource and allow us 45 days to secure adequate financing. Because this restoration will be restoring mill: the front section and will involve separating part of the structure we propose the following as an offer to purchase the west portion building section (approximately 65 teet; of the old Ozark Theater. It is my understanding that a parking c..CCK would be constructed on the east section oi the property. Vehicular access to :he parking deck can be maintained on both the north side of the property and along the south siction parking area. The following items shouid be the condition of the sale. Because this is a separation ot a building I trust that constant coordination and cooperation will be rnairndr.LLne.ween the City and the restoration proiect. We will perform a phased restoration of the west portion building section. The first phase to include the exterior and a portion of the interior. All title abstracts will remain with the as:oration portion. We will perform the separation demolition of the theater balcony structure from the hack (east) wall of the restoration. The City would remove the east section of building with debris and allow us about 6 months of restoration work Defore construution would begin on a parking deck. Because of the requirement of two exits from a building, an east exit will have to be maintained. Coordination will have to occur during the construction of the parking deck to allow safe temporary egress from the restoration and permanent egress when the deck is finished. BOB H. Because ot the RTC requirement and because almost all of the friable asbestos is in the east section, the City will remove all ot :he asbestos and hazardous material from the property. Al: of the above is contingent on us obtaining adequate financing for the restoration. The properties that define Fayetteville's heritage are diverse. My Great-grandfather lived on College Avenue at the turn of the Century and very little of the properties and character of the early 19CC's remains. The Ozark Theater reflects an aspect ot a shared experience for Fayetteville and the State of Arkansas and should be preserved to interpret that shared experience for tuture generations. A RESOLUTION ACCEPTING THE PROPOSAL OF THE OFFSTREET PARKING DEVELOPMENT Disarrucar NO. 1 FOR THE DEMOLITION OR RESTORATION OF THE OZARK THEATHER BUILDING. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby accepts the proposal of the Offstreet Parking Development District No. 1 for the demolition or restoration of the Ozark Theather building. A copy of the proposal is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 19th day of April 1994.
