HomeMy WebLinkAbout44-94 RESOLUTIONRESOIAJTioN NO: 44-94 A RESOLUTION ACTING UPON THE APPEAL OF THE MARCH 14, 1994 DECISION OF THE PLANNING COMMISSION TO APPROVE THE PRE1,IMINARY PI AT OF THE PROPOSED JACKSON PLACE DEVELOPMENT BY REFERRING THE PROPOSED PRLLIMINARY PLAT BACK TO THE PLANNING COMMISSION FOR ADDITIONAL FINDINGS. WHEREAS, the Planning Commission approved the preliminary plat of the proposed Jackson Place development on or about March 14, 1994, and WHEREAS, Councilman Fred Vorsanger appealed that decision on or before March 15, 1994 pursuant to §159.12 of the Code of Fayetteville: and WHEREAS, the City Council met on April 5. 1994 and heard all persons desiring to be heard on the question of whether the decision of the Planning Commission was in error. NOW, THEREFORE., BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. The proposed preliminary plat of the Jackson Place development is hereby referred back to the Planning Commission for the following additional findings: a) The adequacy of the drainage for the development should be re- examined in light of the new engineer's report received by the City Council at their April 5, 1994 meeting. b) The impact of the development upon existing and proposed sewer lines, especially potential overflow problems, should be re- examined Section 2. The City Council rixommends that the Planning Commission re-examine the issue of dedicated greenspace within the Jackson Place development. PASSED AND APPROVED this _,5& day of April , 1994.
