A RESOLUTION AUTHORIZING MAYOR AND CITY CLERK
IO EXECUTE THE MEMORANDUM OF UNDERSTANDING
ADOPTING THE TRANSFER OF OPERATIONS OF THE
ANIMAL. SHELTER FROM THE HUMANE SOCIETY TO THE
CITY OF FAYETfI-V1141.E, AND APPROVAI. OF A BUDGET
ADJUSTMENT OPERATING REVENUE FOR THE
REMAINDER OF 1994.
BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. 1 hat the Council hereby authorizes the Mayor and City Clerk to execute
the Memorandum of Understanding transferring operations of the Fayetteville Animal Shelter
from the Humane Society to the City. A copy of the memorandum is attached hereto marked
Exhibit "A" and made a part hereof.
Section 2. The Council hereby approves a budget adjustment to recognize new revenue
sources that will he received by the City in conjunction with the operation of the shelter (See
Attachment A), to utilize $21,214 of General Fund Unreserved Fund Balance to cover projected
shortfalls for the remainder of 1994 (See Attachment A), and to establish a new expenditure
budget for the Animal Shelter progam in the City's General Fund (See Attachment B). A copy
of Attachment A and Attachment 13 are attached hereto and made a part hereof.

MEMORANDUM OF UNDERSTANDING
City of Fayetteville and Humane Society of the Ozarks, Inc.
Re: Operation cf Animal Shelter
WHEREAS: By agreement dated August 15, 1989, the City of
Fayetteville (City) and the Fayetteville Humane Society,Inc.
predecessor Lo Humane Society of the Ozarks, Inc. (Society), the
City leased to the Society a parcel of land located on Armstrong
Road for the purpose of construction and operation of an animal
shelter;
WHEhEAS: The City and tl:e Society jointly funded the construction
of the anima: shelter;
WHEREAS- By Contract tor Services renewed annually the City paid
the society a suer. of :Honey and provided certain support in
exchange for Society operation of the Animal Shelter and
enforcement of City animal control ordinances; and,
WHEREAS. The City and the Society are unable to agree on the
terms of operation and the support to be provided by the City for
operation of the Animal Shelter.
NOW THEREFORE., the Contract for Services has not been agreed for
the Society to operate the Animal Shelter tor the year 1994 and
the City and the Society have dissolved their agreements as
follows:
1. The City monthly payments tor services under the terms of the
expired Contract for Services shall cease the 28th day of
February, 1994.
2. The City shall assume operational control cf shelter employees
and responsibility tot operation of the Animal Shelter from the
1st day of March, 1994.

3. The Scciety will pay Animal Shelter obligations and bills
which become due or. or before Fobruaxy 28, 1994.
4. The Society may continue for a period of not more than one
year to use without payment of rent a part of the Animal Shelter
education room for its administrative and educational activities.
Atter one year the City and the Society may agree on appropriate
occupancy and activities.
5. The Lease Agreement dated August 15, 1989 is terminated
without payment of money by the City or the Society, it being
understood that the facia ty will for the foreseeable future be
operated as an animal shelter.
6. The City and the Society intend to continue a close
association fox promotion of humane treatment of animals and
operation of the Animal Shelter to serve the citizens of
Fayetteville

ANNUAL ANIMAL SHELTERING AGREEMENT
This Agreement is entered into this 1st day of March
1994 by and between The City of Fayetteville (hereafter called
"Fayetteville") and the City of West Fork (hereafter called "West
Fork") for the following purposes and upon the indicated
conditions.
FAYETTEVILLE will accept animals delivered to it's shelter AT
1640 Armstrong Avenue, Fayetteville, Arkansas by designated animal
control officers and citizens of WEST FORK.
WEST FORK will on the first day of each month hereafter pay
FAYETTEVILLE for this service a sum representing the pro rate
allocation of FAYETTEVILLE'S approved budget for the current year
based on the population of Washington County excluding the City of
Springdale which maintains it's own animal shelter facility and
program.
WEST FORK'S allocation of the current budget is an annual sum
of $2,826.70 to be paid in ten (10) equal installments of $282.67,
beginning March 1, 1994.
WEST FORK will be allowed access to the resources of
FAYETTEVILLE as the same may benefit it's citizens in such areas as
ordinance preparation, educational program, consultation regarding
animal control matters etc.
