BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Council hereby approves Amendment No. 3 to Task Order No. 1 with McClelland Consulting Engineers. in the amount of $22,300.00 for construction observation necessary to cover expenses associated with the Taxiway Extension Protect (AIP# 17). City Clerk AMENDMENT NO. 3 TO TASK ORDER NO. 1 Drake Field Improvements Fayetteville Municipal Airport Fayetteville, Arkansas Task Order No. 1 dated February 2, 1993, and Task Order No. 1 to the BASIC AGREEMENT executed February 2, 1993 , between McClelland Consulting Engineers, Inc., (ENGINEER) and City of Fayetteville, Arkansas (OWNER) in accordance with the provisions of that Agreement is amended hereinafter for the purpose of increasing the scope of services to include additional Construction Observation Time. Specifically, these revisions to Task Order No. 1 are to be effected by the following changes: Add subparagraph 7 for Additional Construction Observation required for the project delay due to the Archaeological Survey required for the project area. This study has caused a portion of the project to be shut down and extended the construction time for this project. 7. Additional Construction Observation Phase: The Owner shall pay the Engineer for the resident construction observation services rendered under Article 1 above. The fee will be based upon the actual hours worked at a maximum hourly rate of $41.28 inclusive of the salary rate, payroll cost of 35% and overhead cost of 119%. The fee for the Construction Observation shall not exceed an amount of $22,300 for a maximum of 540 hours of observation time except as amended by separated Task Order or Amendment. FS/ -Stu - 4750 Fa F Dear Mr. Frederick: This is in response to your letter dated January 19, 1994, regarding the proposed modifications to the Engineering Services and Archeological Investigation Contracts and the proposed Change Order to the construction contract at Drake Field Airport under AIP Project No. 3-05-0020-17. We have reviewed the above mentioned documentation and concur with your recommendations as follows: 1. The construction change order is approved in the amount of $70,957.20 subject to the availabihty of Federal funding. 2. The amendment to the Engineering Services agreement is approved subject to the availability of Federal funding; however, Federal participation will be limited to direct labor, indirect labor, and overhead costs without profit. As we discussed, this yields a maximum hourly rate of $41.28. 3. The amendment to the Archeological Contract for additional work to develop the Memorandum of Agreement and Treatment Plan will be reviewed and approved following negotiations between the Airport and the Consultant. Please provide a fully executed copy of each of these documents for our files. As you are aware from previous conversations, this project has encountered several obstacles due to discovery of historical sites in the project area. Be advised that the enclosed change order and amendment have been discussed at length with the contractor and the engineer. After this review, I concur with the engineer's recommendation to approve both items. Due to the down time involved, the extended construction and the expenses incurred through the archeological work it will be necessary to request an amendment to this project. At this time I would like to request a grant amendment of $90,000.00 based on the availability of federal funds. With matching funds, this will allow for an additional 100,000.00 project cost. This should cover the known estimates of $87,951.20 ($79,156.08 federal) and allow for a modest project contingency should it be required. As you can see, this is well within the 15% amendment amount allowable for the project. Please advise me at your earliest convenience regarding the change order, task order amendment and grant amendment. If you should have any questions, please do not hesitate to contact this office. The additional costs are the result of discovery of historic sites located in the south project area. In accordance with federal guideline, all work was stopped on the project. Several weeks after preliminary archeological review, work was allowed to resume at the north end of the airport, however, work on the south end is still stopped. This has resulted in additional construction observation cost since the work is not ongoing simultaneously. In addition, the contractor has elected to work 10 and 12 hour days which has also increased the construction observation hours needed for the project. The FAA has reviewed and concurs with these expenses. A budget adjustment is attached to the construction change order request which will pay the expense associated with this Amendment. These expenses will be included in a grant amendment upon the availability of federal funds at the end of the project. The amendment to the grant will reimburse 90% of these costs.
