A RESOLUTION AUTHORIZING A CONTINGENCY

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby approves a contingency amount of
$354,783.00 for the 36" water transmission line and storage tank project.

1.08 MANUFACTURERS' FIELD SERVICES
A. When specified in respective Specification Sections,
require supplier or manufacturer to provide qualified
personnel to observe field conditions, conditions of
surfaces and installation, quality of workmanship,
start-up of equipment, test, adjust and balance of
equipment as applicable, and to make appropriate
recommendations.
B. Representative shall submit written report to Engineer
listing observations and recommendations.

TESTING LABORATORY SERVICES
A. Owner will employ a Testing Laboratory to perform
inspections. tests, and other services required by
individual Specification sections.
B. Owner shall pay for initial laboratory testing of
earthwork, base, asphalt, and concrete. If, however,
initial test fails, retesting must be paid for by the
Contractor.
C. Services will be performed in accordance with
requirements of governing authorities and with specified
standards.
D. Reports will be submitted to Engineer. Owner and
Contractor giving observations and results of tests,
indicating compliance or non-compliance with specified
standards and with Contract Documents.

MODIFICATION TO BASIC ENGINEERING
SERVICES AGREEMENT TO PROVIDE
COMPENSATION FOR CONSTRUCTION MATERIALS TESTING
This Tads Order Is hereby made a part of the Basic Agreement executed November 6, 1990, between
McCLEU.AND CONSULTING ENGINEERS, INC. IENGINEERJ and the CiTY OF FAYETTEVILLE (OWNER} in
accordance with the provisions of that Agreement.
ARTICLE 1
The OWNER authorized the ENGINEER to design a 36 -Inch water main, interconnecting mains
and two water storage tanks under Task Order No. 1 and No. 2 to the Basic Agreement, as
executed June 3, 1991. These facilities are currently under construction. As part of the
Construction Observation process, the ENGINEER has authorized and expects to continue to
authorize construction materials testing, including:
1. Compaction tests for earthwork at the tank site.
2. Compaction tests for pipeline backfill In street crossings.
3. Concrete cylinder test for structural concrete used on the project.
Compensation for these additional engineering services Is not addressed In the Basic
Agreement or previous Task Orders. The purpose of this Task Order Is to establish rates and a
maximum fee not to be exceeded.
ARTICLE 2
The compensation for these additional engineering services shall be In accordance with the
attached laboratory Fee Schedule doted November 1994, with the maximum compensation
not to exceed $15.000, without further authorization from the OWNER.
