A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A CONTRACT AMENDMENT TO
ALLOW WEST FORK TO SELL WATER TO THE
WASHINGTON WATER AUTHORITY PROVIDING WATER
TO THE SOUTH WASHINGTON COUNTY RURAL AREA.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby authorizes and directs the Mayor and City
Clerk to execute a contract amendment to allow West Fork to sell water to the Washington Water
Authority providing water to the South Washington County rural area. A copy of the contract
authorized is attached hereto marked Exhibit "A" and made a part hereof.

AMENDMENT NO. 1
TO
WATER PURCHASE CONTRACT
BETWEEN THE CITIES OF FAYETTEVILLE AND WEST FORK
The purpose of this amendment is to provide authorization to the
City of West Fork to sell water through two master meters to the
Washington County Rural Development Authority, and its successors,
for rural water users east of the City of West Fork. One master
meter shall be located on Owl Hollow Road and the second master
meter shall be located on Mineral Springs Road. The total water
sold through both of these meters shall not exceed 1,500,000
gallons per month.
The third paragraph on page 1 of the Water Purchase Contract shall
be revised from:
"WHEREAS, the Buyer desires to purchase water from the
City for distribution within the present corporate limits
of Buyer and to residents within reasonable proximity to
the transmission line, and the City desires to furnish
and sell water to the Buyer for distribution as
aforesaid."
to read as follows:
"WHEREAS, the Buyer desires to purchase water from the
City for distribution within the present corporate limits
of Buyer, to residents within reasonable proximity to the
transmission line, and to the Rural Development Authority
and its successors through two master meters, and the
City desires to furnish and sell water to the Buyer for
distribution as aforesaid."
Paragraph B.1. on page 3 of the Water Purchase Contract shall be
revised from:
"B. The Buyer agrees:
1. To purchase water as required by the Buyer and the
consumers within the present corporate limits of the
Buyer, and a service area along the transmission line as
determined in Paragraph C 8 hereof up to a maximum of 600
gallons per minute. Buyer shall be under no obligation
to purchase any water from the City unless Buyer so
elects, but any water purchased by Buyer shall be from
the City and not from some other source."
to read as follows:

"B. The Buyer agrees:
1. To purchase water as required by the Buyer for the

Buyer, for the consumers within a service area along the
transmission line as determined in Paragraph C 8 hereof,
and for the two master meters to be used to provide water
service to the Rural Development Authority and its
successors, up to a maximum of 600 gallons per minute.

from the City unless Buyer so elects, but any water
purchased by Buyer shall be from the City and not from
some other source."
The following shall be added under Paragraph C.B. on pages 6 and 7
of the Water Purchase Contract, immediately prior to Paragraph
C.9..
"In addition to being authorized to sell water within the
corporate limits as defined by Paragraph C.8., the Buyer
is hereby authorized by the City to sell water through
two master meters, one located on Owl Hollow Road and one
located on Mineral Springs Road, to the Rural Development
Authority and its successors."

IN WITNESS WHEREOF, the City and Buyer have executed these presents
by their respective mayors and have caused their seals to be hereto
affixed and the same attested to by the City Clerks of the parties,
having been authorized to do so by appropriate ordinances of their
respective Governing Bodies.
