A RESOLUTION AUTHORIZING THE ACCEPTANCE OF A
$12,000 COUNTER OFFER TO PURCHASE PROPERTY FOR
THE AIRPORT LAND ACQUISITION PROJECT FROM THE
W.C. WHITFIELD, JR. TRUST AS SETTLEMENT IN RE:
CITY OF FAYETTEVILLE V. DUNLAP/WHITFIELD, CIV 93-
491.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
,Section 1- That the Council hereby accepts the Whitfield Trust attorney-in-fact, Gerald
Jones' S12,000 counter offer to purchase property for the airport land acquisition project from
the W.0 Whitfield, Jr. Trust as settlement in re- City of Fayetteville v. Dunlap/Whitfield, CIV
93-491.

Obstruction Lighting Easement
Dear Mr. Jones:

The W.D. Schock Company has received a copy of your letter
d ated June 12, 1993, to Mr. Jerry Rose in which you have made a
counter offer of $12,000.00 to our original avigation and
o bstruction lighting easement offer of $10,500.00.
The W.D. Schock Company feels that the amount of $12,000.00
w ill be acceptable to the FAA and therefore requests that you
sign on the designated line below to verify your acceptance of
an administrative settlement in the amount of $12,000.00 based on
the original avigation and obstruction lighting easements in our
o riginal offer dated January 25, 1993, that were appraised on
December 22, 1992, by The Real Estates Consultants.
Once we have obtained your signature, we will proceed in
setting up the closing with the proper parties.

Dear Mr. Rose:
This letter will confirm our willingness to settle the
acquisition of this easement, as originally proposed, for
the sum of $12,000.00.
It should be noted that the appraisals we have received
to date make no clear and discernible mention of the
following: (1) Environmental Damage
(2) Severance Damages
(3) Damage to Intended Use
Should we not hear from you on or before, July 15, 1993,
we will assume that no settlement is possible and you are
directing us to procede thru the courts.
