RESOLUTION NO. 63-93
A RESOLUTION AWARDING BID NO. 93-23 TO WILLIAMS
FORD TRACTOR IN THE AMOUNT OF $58,980 FOR TWO
FORD MODEL 575D TRACTOR/BACKHOE/LOADERS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That Bid No. 93-23 is hereby awarded to Williams Ford Tractor in the
amount of $58,980 for two Ford Model 575D tractor/backhoe/loaders, which mcludes a trade
allowance of $14,400 for Unit #603 and $19,900 for Umte #613. A copy of the bid tabulation
is attached hereto marked Exhibit "A" and made a part hereof.

the place of beginning, the same being located in the city of Fayette-
ville, Arkansas.
Of the above consideration the sum of $30.00 is paid cash in hand and
the balance of $370.00 is to be paid as follows: Thirty Dollars on the
1st day of December, 1921, and Thirty Dollars every ninety days there-
after until the balance of the purchase price of said land together with
the interest thereon has been fully paid. A Vendor's Lien is hereby
retained on said real estate for the payment of the purchase price
thereof said purchase price being evidenced by 10 promissory notes for
thirty dollars each, the first of said series of notes become due and
payable on the first day of December, 1921, and one of said series of
notes, becoming due and payable 90 days thereafter until the entire
series of notes with interest thereon has been fully paid. Each of
said notes bearing interest at the rate of 10% per annum, payable

May 1939 term of this Court, this cause came on to be heard and the plain
tiff appeared by its attorney and announced ready for trial but the def-
endants came not. Whereupon, this cause was submitted to the Court upon
the complaint of the plaintiff, the exhibits thereto, the proof of servic
and the evidence both oral and documentary adduced at 9he hearing and the
Court finds:

The Court further finds that this is a proceeding in rem and that a
notice and warning order was duly published in this cause, and that all
owners of the property hereinafter described were duly notified of the
nature and pendency of this suit and warned to appear within this Court
within the time prescribed by law, and that said notice and warning order
was duly published for the full number of consecutive insertions and the
full length of time required by law in a newspaper printed and published
and having a general bona fide circulation in Washington County, Arkansas
and that the time for making defense to said suit has expired and that

Clint Jones is hereby named as the Commissioner of this court and is herby
directed to sell the lands, lots, blocks, or parcels of land, railroad
tracks, and right of way herein described at the West front door or en-
trance of the court house in Fayetteville, Washington County, Arkansas,
at public out -cry to the highest and best bid for cash in hand after
having first advertised such sale for two (2) weeks consecutively in
some newspaper printed and published and having a general bona fide fir-
culation in Washington County, Arkansas; and said Commissioner is further
directed that if all the lands, lots, blocks, or parcels of land, and
railroad tracts, and right of way be not sold on the day as advertised,
such sale shall continue from dat to day until completed and such Commissioner
shall by proper deed convey to the purchaser the lands, lots, blocks, or
parcels of land, railroad tracks, and right of way sold and the title td
such property shall thereupon become vested in such purchaser as against
all others whomsoever saving to infants and to insane persons having no
guardians or curator the rught they how have by law to appear and except
to said proceedings within three years after their disabilities are remo%ed
and said sale shall also be made subject to the right of redemption as now
provided by law, and said Commissioner is hereby directed to report his
proceedings hereunder to this Court when said sale is completed or as
soon thereafter as a report can be prepared.
This decree was rendered on thel9th day of May, 1939, same being the
fifth day of the Regular May 1939 Term of said Court, and is entered this
25th day of May, 1939, for them.

of Arkansas, by its attorney General, Bruce Bennett, and no one having

certificate of the State Land Commissioner and proof of publication of
notice herein.

Prosecuting Attorney for the Fourth Judicial Circuit, the
Intervenor appearing in person and by his attorney, Bobby L.
