A RESOLUTION APPROVING A SETTLEMENT AMOUNT OF
$39,158.44 AND COSTS OF $441.00 IN FULL SATISFACTION
OF JUDGMENT IN RE: JOHN V .RNON W SON V CITY OF
FAYETTEVII.I.F SUPREME COURT NO. 91-290
REGARDING A SEWER EASEMENT LOCATED ON THE
CORNER OF GARLAND AND NORTH STREETS AND
APPROVAL OF A BUDGET ADJUSTMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section I. That the City Council hereby approves a settlement amount of $39,158.44
and costs of $441.00 m full satisfaction of judgment In Re: John Vernon Wilson v. City of
Fayetteville, Supreme Court No. 91-290 regarding a sewer easement located on the corner of
Garland and North Streets.
Section 2. The City Council hereby approves a budget adjustment m the amountof
$39,599 decreasing Acct. Use of Fund Balance, Acct. No. 2100-0910-4999.99 to increase Acct
Settlements, Acct. No. 2100-4120-5311A/9. A copy of the budget adjustment is attached hereto
and made a part hereof.

NOW on this "ht -/J day ofd Z'izU/�, 1993, this cause
comes on for hearing on remand from the Ark�p,, ._(sas Supreme Court "for
the trier of fact to consider whether compound interest is
necessary to afford 'just compensation'." From the stipulations
submitted and the evidence adduced, the Court finds as follows:
1. The parties have stipulated that this cause has been
compromised and settled and should be dismissed with prejudice.
2. That the additional sum of $39,158.44 plus costs of
$441.00 shall be paid by the City of Fayetteville, Arkansas, to
John Vernon Wilson as full payment of just compensation for the
taking of the subject property easement.
IT IS SO ORDERED, that this cause be and hereby is dismissed
with prejudice.
