A RESOLUTION AWARDING BID NO. 93-44 TO ARK -O
PETROLEUM EQUIPMENT IN AN AMOUNT NOT TO
EXCEED $39,512.39 FOR INSTALLING AN UNDERGROUND
STORAGE TANK MONITORING SYSTEM AT THE
FAYETTEVILLE MUNICIPAL AIRPORT, AND APPROVAL
OF A BUDGET ADJUSTMENT IN THE AMOUNT OF $1,311.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That Bid No. 93-44 is hereby awarded to Ark -O Petroleum Equipment in
an amount not to exceed $39,512.39 for installing an underground storage tank monitoring
system at the Fayetteville Municipal Airport. The Mayor and City Clerk are hereby authorized
and directed to execute the contract for installation of an underground storage tank monitoring
system. A copy of the bid tabulation and contract are attached hereto and made a part hereof.
Section 2. That Council hereby approves a budget adjustment mcreasing Acct. No.
5550 3960 5801 00, Fixed Assets in the amount of $1,311 00 by decreasing Acct. No. 555 0955
4999 99, Use of Fund Balance. A copy of the budget adjustment is attached hereto and made
a part hereof.

CONTRACT FOR INSTALLATION OF A UST MONITORING SYSTEM FOR THE
CITY OF FAYETTEVILLE MUNICIPAL AIRPORT
This agreement made the 16th day of November 1993, by and
between Ark -0 Petroleum Equipment hereinafter called "Contractor" and the
City of Fayetteville, hereinafter called the "City" shall be utilized to
provide the following services:
The Contractor hereby agrees to provide all necessary equipment,
materials and incidental items, and all labor required to accomplish every
detail of the installat,.ion of the underground storage tank monitoring system
at the Fayetteville Municipal Airport in accordance with the bid documents
and specifications (bid 93-44). For this work, at total amount "not to
exceed" $1q_512.39 was bid. This project is to be considered a "turn key" job
and shall include all items as provisions set forth in the bid specifications
attached hereto and made a part hereof.
The project time frame shall coincide with the number of days stated in
the bid documents ( 3Q working days) which were submitted to the Purchasing .
Officer. Liquidated damages of $100 per day shall be assessed at the option
of the City, not as a penalty, beginning on the first day following the
completion time entered on this bid to cover additional costs.
If the bid exceeds $10,000, the Terms and Standard Conditions of the
City of Fayetteville expressed in item 19. A/B/C shall be considered a
binding part of this agreement and shall be provided by the Contractor.
A 10% retainage of the total project bid shall be held by the city until
the project has been completed and accepted by the City.
