RESOLUTION NO. 79-92
A RESOLUTION URGING THE GENERAL ASSEMBLY OF
THE STATE OF ARKANSAS TO PLACE A
CONSTITUTIONAL AMENDMENT BEFORE THE PEOPLE AT
THE NEXT GENERAL ELECTION REQUIRING THAT
BEFORE STATE GOVERNMENT MANDATES THAT
MUNICIPALITIES PROVIDE CERTAIN SERVICES THAT
THE STATE PROVIDE FUNDING FOR SUCH.
WHEREAS, the issue of mandates is becoming an increasingly
sensitive one for local government officials; and
WHEREAS, the federal government has practically written
itself out of any federal/local financial partnership leaving state
and local governments "holding the bag"; and
WHEREAS, with increasingly stretched state fiscal resources,
local government often becomes the convenient answer as a home for
well-intentioned, yet costly, programs that neither the federal
government nor the state government has the ability or desire to
fund; and
WHEREAS, an unfunded mandate is especially insidious in that
it means that the money to pay for the mandate must be "borrowed"
from another program or, additional revenues must be raised; and
WHEREAS, unfunded mandates often become "hidden taxation"
because they give the state the ability to initiate a program
without having to actually pay for it.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That out of a sense of fiscal fair play and
truth in taxation, a Proposed Constitutional Amendment is needed
and necessary in order to give the local governments of this state
relief from unfunded mandates.
Section 2. That such a Proposed Constitutional Amendment
would specify that any new legislation or regulation that required
additional expenditures by local government, either in terms of
human or monetary resources, could not be implemented or imposed
without full state funding or increased fiscal capacity for local
government.
Section 3. The Board of Directors of the City of
Fayetteville, Arkansas respectfully requests that the Members of
the Seventy -Ninth General Assembly refer a Proposed Constitutional
Amendment, calling for "No -More Unfunded Mandates", to the electors
of the State of Arkansas in the General Election of 1994 and that

a copy of this Resolution be forwarded to the Members of the
General Assembly, the Governor, the Lieutenant Governor of
Arkansas, and the Arkansas Municipal League.
