A RESOLUTION ACCEPTING THE SETTLEMENT OFFER
PRESENTED BY MR. & MRS. MERLIN AUGUSTINE,
THROUGH THEIR ATTORNEY, IN RE: AUGUSTINE V.
WARD OF ADJUSTMENT, CIV 91-559.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1 That the Board of Directors hereby accept the
settlement offer presented by Mr. & Mrs. Merlin Augustine, through
their attorney, In Re: Augustine v, Board of Adjustment, C1V 91-
559, as follows:
1. Dr. Augustine agrees to reduce his structure from
24'x 24' to 24'x 18. The six foot reduction
reduces the setback violation from 10.5' to 4.5'.
2. Dr. Augustine's suit aginst the City is dismissed
with prejudice.
3. The City will pay the sum of $657.00 to mr.
Augustine for a new easement reflecting the area
across which the City has an existing.
