A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN ENGINEERING CONTRACT
AMENDMENT WITH MILHOLLAND ENGINEERING IN THE
AMOUNT OF $191300.00 FOR THE STUBBLEFIELD
ROAD/MISSOURI CREEK DRAINAGE PROJECT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute an engineering contract
amendment with Milholland Engineering in the amount of $191300.00
for the Stubblefield Road/Missouri Creek Drainage Project.
A copy of the contract authorized for execution hereby is
attached hereto marked Exhibit "A" and made a part hereof.

CONTRACT AMENDMENT NO. 2
FOR
ENGINEERING SERVICES
PROJECT:
STUBBLEFIELD ROAD AND MISSOURI CREEK DRAINAGE IMPROVEMENTS

THE ORIGINAL CONTRACT was made and entered into on May 24, 1989$
AND THIS CONTRACT AMENDMENT NO. 2, made and entered into this
74 day of , 1991, by and between the City
of Fayetteville; Arkansas, hereinafter referred to as the
"OWNER", and Milholland Company, Engineering and Surveying,
Consulting Engineers of Fayetteville, Arkansas, hereinafter
referred to as the "ENGINEER",
WITNESSED THAT:
WHEREAS, the OWNER Originally desired to Construct STUBBLEFIELD
ROAD 31 feet in width from BERTHA STREET Easterly to Old Missouri
Road centered in a Right -Of -Way fifty feet (50') in width, AND
WHEREAS, the OWNER has AMENDED its desires several times, as
follows:
FIRST: Construct Stubblefield Road from Harold Street,
North and East to Old Missouri Road;
SECOND: Construct Stubblefield Road from Old Missouri
Road, Westerly into the alignment of Bertha Street
with future plans to connect directly into North
College;
THIRD: Construct Stubblefield Road from Old Missouri,
West and South to Harold Street with the following
additions and adjustments:
A.) Relocate centerline of East/West portion of
Stubblefield Road three feet (3') to the
North;
B.) Relocation of cable telephone by SWBTCO;
C.) Water Main Replacement from Summerhill Drive
East to Loxley Avenue;
D.) Negotiation with Local Land Owners to
preserve certain natural features, such as
Particular trees and provide for additional
Driveways and fence Relocations which have
been constructed since original design;

E.) Construct a Concrete sidewalk along the North
side of Stubblefield Road; AND
WHEREAS, the OWNER has AMENDED its desires as to how the
Construction of the Missouri Creek Drainage Improvements from
Stubblefield Road North to Mud Creek should be accomplished, as
follows:
FIRST: Originally: Improve entire Channel for 50 -year
Flood Utilizing open channel with option of a
Concrete Box Channel;
SECOND: City negotiated with Land Owners over which
existing creek flows, for a specific type of
construction at different locations, as approved
by Land Owners, for a 50 -year Flood with 100 -year
flow Flood Easement adjacent to Main Channel, with
adJustments and changes, as follows:
A.) Open earth channel from Stubblefield Road
North to Old Well House;
B .) Concrete Box Culvert from Old Well House,
North to a point of interception of storm
drainage from the East through a culvert
under Old Missouri Road (Approx. 220 L.F.);
C.) Additional drainage structure across Old
Missouri Road to connect into North end of
"B" above;
D .) Clean debris out of existing channel from
North end of Concrete Box Culvert in "B"
above (Approximately 700 L.F.);
E .) Construct improved earth Channel, parallel
w ith existing Channel from North end of "D"
above, North to Mud Creek (Approx. 800 L.F.);
F.) Repair and replace broken native stone wall
South of David Wilson's Driveway and protect
e xisting native stone walls and stone piers
at Mr. Wilson's driveway; AND
WHEREAS, the OWNER deemed it essential to delay and modify its
original plans, AND
WHEREAS, the ENGINEER has sufficient experienced personnel and
equipment to perform the work described in this Agreement, as
Amended,
NOW THEREFORE, in consideration of the mutual covenants and
agreements herein contained, the OWNER and the ENGINEER, the
parties hereto, stipulate and agree that the OWNER does hereby
employ the ENGINEER to perform the required engineering services
as hereinabove set out; AND the ENGINEER agrees to provide said
Additional services.

SECTION 1: DESCRIPTION OF PROJECT AS AMENDED:
The Project for which engineering services are to be provided are
as follows:
PROJECT No. 1 - STUBBLEFIELD ROAD IMPROVEMENTS FROM HAROLD
STREET NORTH AND EAST TO OLD MISSOURI ROAD including, but
not limited to, Street and Storm Drainage Construction,
Water Main Replacement and Sidewalk Construction;
PROJECT No. 2 - MISSOURI CREEK IMPROVEMENTS as amended,
herein above;
which are generally described as follows:
The balance of SECTION 1 AND ALL OF SECTION 2 OF THE "ORIGINAL
CONTRACT" shall remain unchanged.
SECTION 3. COMPENSATION AS AMENDED:
Compensation for the various types of services to be provided
under this contract shall be made as follows:
PROJECTS No. 1 AND 2: STUBBLEFIELD ROAD AND MISSOURI CREEK
IMPROVEMENTS:
A. PART I: BASIC ENGINEERING SERVICES:
Compensation for Basic Engineering Services shall be a LUMP
SUM FEE amount of $23,000.00 FOR AMENDMENT NO. 2 INSTEAD OF
CONTRACT AMENDED AMOUNT OF $11,000.00. This fee includes
full compensation for every item of work as described in
SECTION 2, PART I. The fee is based on an estimate of the
various classifications of work at an hourly rate. The
hourly rates include direct labor costs plus allowances for
indirect labor costs, overhead, and profit.

PROJECT No. 3: MISSOURI CREEK DRAINAGE STUDY:
C. PART II: BIDS THROUGH AWARD OF CONTRACT:
Compensation for "Advertisement for Bids" through "Award of
Contract" shall be a LUMP SUM FEE amount of $600.00 FOR
AMENDMENT NO. 2 INSTEAD OF ORIGINAL CONTRACT AMOUNT OF
$400.00.
D. PART III: CONSTRUCTION MANAGEMENT:

In SECTION 2, PART III, shall be a Lump Sum fee as follows;
PROJECT No. 1: STUBBLEFIELD ROAD: Compensation for

$7,500.00 with a maximum Construction Time of 90

PROJECT No. 2: MISSOURI CREEK IMPROVEMENTS: A LUMP
SUM FEE amount of $4,900.00 FOR AMENDMENT NO. 2 INSTEAD
OF ORIGINAL CONTRACT AMOUNT OF $2,500.00 with a maximum
construction time of 60 consecutive Calendar Days or
less from date of "NOTICE-TO-pROCEED" to construction
contractor.
E. HOURLY RATE PER CLASSIFICATION: (AMENDED)
The hourly rates to be charged for the various classifications of
personnel are set out below are AMENDED from Original Contract,

CONTRACT AMENDMENT
FOR
AGREEMENT FOR ENGINEERING SERVICES
IN WITNESS WHEREOF, the OWNER has caused these presents to be
executed in its behalf by its duly authorized representatives,
and the said ENGINEER by its duly authorized representatives, and
the parties hereto have set their hands and seals on the date
heretofore set out.
