BE IT RESOLVED BY THE HOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute a contract with Irwin Seating Company approving theatre seating in Baum*Walker Hall of the Walton Arts Center in the amount of $210,699.72 to be paid from the Joy Pratt Markham Fund (University Fund). A171-1990 3 ARTICLE 5 PROGRESS PAYMENTS 5.1 Based upon Applications for Payment submitted to the Archaect by the Contractor and Certificates tor Payment issued by the Architect. the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided in the Contract Documents. 5.2 Upon delivery of materials to the project site, at the Contractor's option., the Contractor may submit to the Architect an itemized application for payment. The Owner will make payments on the basis of one hundred percent (1CO%) of the portion of the Contract Sum properly allocable to materials and equipment suitably stored at the site. Include attachments indicating quantities and costs of materials stored along with back-up material justifying amounts claimed for materials stored. 5.3 Upon substantial completion of the Work the Contractor shall submit to the Architect an itemized application for payment. The Owner will make payments on account of the Contract Sum to the Contractor in the amount of ninety percent (90%) of the Contract Sum, less the aggregate amount of previous payments.
