A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE THE CONTRACT RENEWING THE
LAKE FAYETTEVIIIR BOAT DOCK OPERATOR'S
CONTRACT WITH JIM BLACK FOR THE 1993 SEASON, IN
THE AMOUNT OF $21,864.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby authorizes and directs the Mayor and City
Clerk to execute the contract renewing the Lake Fayetteville boat dock operator's contract with
Jim Black for 1993 season, in the amount of $21,864. A copy of the contract authonzed far
payment are attached hereto marked Exhibit "A" and made a part hereof.

CQNTRACT
This CONTRACT executed this
day of f� •

1992, by and between the City of Fayetteville, Arkansas, herein-
after called the "City," and Jim Black, hereinafter called the
"Operator."
WHEREAS, the City of Fayetteville owns a boat dock at Lake
Fayetteville; and,
WHEREAS, the City desires to contract for the operation of
said boat dock; and,
WHEREAS, the Operator desires to operate a business at said
boat dock.
NOW, THEREFORE, the City and Operator hereby mutually agree as
follows:
1. The City hereby retains the Operator to operate the City's
boat dock at Lake Fayetteville. The Operator shall be an
independent contractor and shall not be a city employee.
2. For services rendered by the Operator under this
contract, the City shall pay the Operator the monthly sum of
$1,822.00 , for a contract total of $ 21,864.00.
3. The Operator shall be permitted to conduct the following
business at the Lake Fayetteville Boat Dock:
(a) Sell concessions in compliance with all State,
Federal and Local regulations;
(b) Sell fish bait:
(c) Provide other services which the City's Parks and
Recreation Director determines will enhance the operations at Lake
Fayetteville.
4. The Cperator shall obtain prior approval of the City's
Parks and Recreation Director, or his/her designee, for any special
event conducted at Lake Fayetteville.
5. The Operator shall open the Lake Fayetteville gate at
sunrise and close said gate at sunset, seven (7) days a week. The
dock shall be closed Thanksgiving day and from December 24th to
January 14th.
6. The Operator shall collect for the City all boat stall and
storage rentals, and all fees for fishing and boating permits.
Said rentals and fees shall be deposited with the City Parks Office
weekly. The Operator shall keep accurate written records of all
such fees and rentals. Said records shall be subject to inspection
by the City. The Operator shall keep such other records and such
reports as may be requested by the City's Parks and Recreation
Director.
7. The Operator shall implement all the rules and regulations
for the use of Lake Fayetteville set out in Chapter 97, Section
97.070 of the Fayetteville Code of Ordinances.
8. The Operator shall maintain, in full force and effect at
all times during the term of this contract, liability insurance
with a minimum coverage of:
(a) $100,000.00 for personal injury or death to one (1)
person; and
(b) $200,000.00 for personal injury or death to two (2)
or more persons.
9. The Operator shall now the yard surrounding the boat dock
office and dock area to maintain a manicured appearance.

Upon budget approval by the City Council, the term of the
shall be for one (1) year commencing January 1, 1993 and
continuing until December 31, 1993.

said Contract may automatically renew for four (4)

each renewal period by the Consumer Price Index. Such automatic
renewal shall be subject to budget approval by the City Council.
12. Either party may terminate this Contract at any time by
giving the other party thirty (30) days written notice of
termination.

Lake Fayetteville Boat Dock Operator Contract
OPERATING CONTRACT FOR LAKE FAYETTEVILLE BOAT DOCK
For the total amount of S24.569.00 to be paid in monthly installments. Jim Black
agrees to provide the list of sen -ices and requirements to the City of Fayette ille
beginning January 1.1997 and ending on December 31. 1997. Fhe term of this agreement is fbr a
one year period. Either party may cancel this contract by giving the other party thirty days written
notice of cancellation. Jim Black further certifies possession of the initial capital
monies to commence boat dock operations.
The City agrees to pay the Contractor in current funds for the performance of the listed sen ices and
requirements by making payments to the contractor on the 15th of each month for the previous 30
day working period.
CONTRACTED SERVICES AND REQUIREMENTS
Operate and manage the Lake Fay elteville Boat Dock. Shall he an independent contractor
not an employee of the City. Must open and close the lake gates seven days a week at
sunrise and sunset. The Lake Fayetteville boat dock is closed each y ear from December 24
through Januar- 14. The operator is responsible for supervising the boat dock during this
time.
2. Collect boat stall rentals. storage rentals. fishing permits. and boating permits. These fees
are submitted to the Parks office on a meekly basis.
3. Prepare reports and keep records as required by the Public Works Director.
4. Enforce lake rules and regulations as adopted by the Fayetteville Code of Ordinances
Chapter 97. Section 97 070 and 97.999.
5. Provide proof of liability insurance with a minimum coverage of:
$300.000 firr one person involved in death or injury.
$500.000 for two or mo.e persons involved in death or injury.
6. Receive prior approval from the Public Works Director for any special e‘ ent conducted at
the lake.
7. Mow the yard surrounding the boat dock office and dock area to maintain a manicured
appearance.
8. Pick-up trash and clean the office and bathroom on a daily basis.
9. Conduct the following business a: the Lake Fayetteville Boat Dock:
a. Sell concessions in compliance with all State. Federal and Local regulation.
b. Sell fish bait.
c. Provide other services which the Public Works Director determines will
enhance the operation of Lake Fayetteville.
10. On call 24 hours a day.
11. Upon budget approval by the City Council. the term of the Contract shall he for one (1) year
commencing January 1. 1993 and continuing until December 31. 1993 however. said
Contract may automatically renew for four (4) consecutive one (1) year terms. with
compensation being adjusted each renewal period by the Consumer Pnce Index for the prior
year. Such automatic renewal shall be subject to budget approval by the City Council.

Labor reported today. For the 12 mcnth period ended :n November, the
CPI -U Increased 1.3 percent.
The Consumer Price Index for Urban Wage Earners and Clerical
Workers .CPI -W1 rose 0.3 percent in November. prior tc seasonal
adjustment The November 1996 CPI -w level at 155.9 was 1.3 percent
higher than the index :n November 1995.

The food and Leverage Index rose 0 3 percent in November. The

increased 0.9 percent, reflecting Increases of 3.4 percent in the index
fcr natural gas and 1.9 percent in the index for fuel oil. The index

index for motor fuel was partially offset by another drop in automobile

adjustment, new vehicle prices rose C.7 percent.; As of November,

The index for apparel and upkeep rose 3.S percent in November the

Medicas care costs rose 0.3 percent in November to a level 3.1
percent above a year age. Phe index for medical care commodities --
prescription drugs, nonprescription drags, and nedi-al s.:pplies--
decl:ned 3.2 percent in November. The index for medical care services
rose C.4 percent. Charges for professional services and hospital and
related services :ncreasea 0.5 and 0.3 percent. respectively.
Entertainment costs rose C.1 percent in Nove-ter following an
increase cf 0.3 percent in October. In Ncvemner the index for
Pnter:ainert commodities was unchanged, while the index for
entertarnne.t services rose 0.3 percent.
The Index for other goods and services Increased 0.4 percent in
November, the same as _n October. The index for tonacco products
increased C.4 percent .n November and has risen 1.8 percent :.. the past
three months.

On a seasonally ad=:.sted basis, the CPI for Urban mage Earners and
Clerical Workers rose C.3 percent in November.

New Seasonal Adjustment Method to be Inp:emented
Effective with the release of revised seasonally adjus•ed data for 1992-
1996 on February :4. 1991, the Bureau of Labor Statistics (BLS) will
begin '.:sing X-:2-ARIMA seasonal adjustment software 'developea by the
Bureau of the Census) for performing Intervent:cr. Analysis Seasonal.
Ad•usinen_ :IASA) for se-ected CP: series. The X 12 ARIMA methodology
incorporates a number of technical enhancements that improve the
estination of seasonal factors. This change will affect 20 CPI series.
.n addition, all remaining Consumer Price Index series requiring
seasonal adjustment will be processed using X-12-AR:MA software
beginning :n February- :49B. Season&. adjustment nethoas in the Prnducer
Price Index will change in similar fashion.

Recalculated Seasonally Adjusted Indexes to be Available on Fenr,.ary 14,
1997
Each year with the release of the January CPI, seasonal ad:ustnent
factors are recalculated to reflect price movements from the just -
completed calendar year. This routine annual recalctlation nay result
.n revisions to seasonally adjusted indexes for the previous 5 years.
B:.S wall make available recalculated seasonally adjusted indexes. as
well as recalculated seasonal adjustment factors, for the period January
1992 through Deccnbex 199E, at 8:30 a.m. on Friday, February 14, 1991.
Seasonal factors for 199' for directly adjusted series will also be
available. :his date is two working days before the scheduled release
of the Jar.,:ary 1997 CPI cn Wednesday, February 19, 1997.
The revised indexes and seasonal factors will be available en tae
intermit at gopter:/'stats.bls.gov. Choose the "special requests"
directory, and then the "cpi" directory. The revised seasonal data will
be in the file tevseas cpi.

Lake Fayetteville Boat Dock Operator Contract
OPERATING CONTRACT FOR LAKE FAYETTEVILLE BOAT DOCK
For the total amount of S18.758.43 to be paid in monthly installments. Jim Black
_ agrees to provide the list of services and requirements to the City of Fayetteville beginning January
1.1998 and ending on September 30. 1998. The term of this agreement is for a nine month period.
Either party may cancel this contract by giving the other party thirty days written notice of
cancellation. Jim Black further certifies possession of the initial capital monies to
commence boat dock operations.
The City agrees to pay the Contractor in current funds for the performance of the listed services and
requirements by making payments to the contractor on the 15th of each month for the previous 30
day working period.
CONTRACTED SERVICES AND REQUIREMENTS
Operate and manage the Lake Fayetteville Boat Dock. Shall be an independent contractor
not an employee of the City. Must open and close the lake gates seven days a week at
sunrise and sunset. The Lake Fayetteville boat dock is closed each year from December 24
through January 14. The operator is responsible for supervising the boat dock during this
time.
2. Collect boat stall rentals. storage rentals. fishing permits. and boating permits. These fees
arc submitted to the Parks office on a weekly basis.
Prepare reports and keep records as required by the Public Works Director.
4. Entirrce lake rules and regulations as adopted by the Fayetteville Code of Ordinances
Chapter 97. Section 97 070 and 47.999.
Prop ide proof of liability insurance with a minimum coverage of:
S300,000 for one person involved in death or injury.
8500.000 for two or more persons involved in death or injury.
6. Receive prior apprm al from the Public Works Director 1br any special event conducted at
the lake.
Mow the yard surrounding the boat dock office and dock area to maintain a manicured
appearance.
8 Pick-up trash and clean the office and bathroom on a daily basis.
9. Conduct the following business at the Lake Fayetteville Boat Dock:
a Sell concessions in compliance with all State. Federal and local regulation.
h. Sell fish bait.
c. Provide other services which the Public Works Director determines 'sill
enhance the operation of Lake Fayetteville.
10. On call 24 hours a day.
12. Either party may terminate this contract at any time by giving the other party thirty (30) days
s ritten notice of termination.

counterparts. each of which will be deemed an original. in the year and day first above mentioned.
