A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE AN EXTENSION '1'O THE ACCESS 4
FAYET'I'EVILLE CONIRACF IN THE AMOUNT OF
$16,666.65, CONTINGENT UPON APPROVAL OF THE 1993
BUDGET.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY 01:
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby authorizes and directs the mayor and city
clerk to execute an extension to the Access 4 Fayetteville contract in the amount of $ 16,666.65,
contingent upon approval of the 1993 budget. A copy at the contract authorized tor payment
are attached hereto markcx' Exhibit "A" and made a part hereof.

EXTENSION TO PUBLIC ACCESS ADMINISTRATION AND
GOVERNMENT ACCESS PRODUCTION ASSISTANCE AGREEMENT
BETWEEN THE CITY OF FAYETTEVILLE
AND
ACCESS 4 FAYETTEVILLE, INC.
Wherefore, on April 1, 1992, the City of Fayetteville, Arkansas entered into an
agreement with Access for Fayetteville, Inc. for the administration of the public access
channel on the Warner Cable System and production assistance for the government access
channel,
Whereas, an May 26, 1992 the citizens of Fayetteville, Arkansas voted to change the
form of government from City Manager to Mayor/Council,
Whereas, the new government took office November 10, 1992,
Because of this transition in Fayetteville's form of government, we feel it is in the
best interests of the citizens of Fayetteville to extend the present contract with Access 4
Fayetteville to give the new government time to study the present method for providing this
service and determine if any changes should be made.
The cost of this extension for three (3) months is $16,666.65 payable at $5,555.55
per month and is contingent upon approval of the 1993 budget.
Attached as Exhibit A and made a part here of as if set out word for word is the
contract with Access 4 Fayetteville effective April 1, 1992.

The City would like to extend Access 4 Fayetteville contract
with the City fur public and government access television services
for an additional two months, through May, 1993.
As you know, Section V1 of your contract states that funds
remaining in your operating accounts on December 3i, 1992 shad be
made available for your 1993 operations. Since your December 31,
1992 Iinancial Statement shows Access 4 Fayetteville to have a
surplus of $7,759.37, we will ask that you apply the bulk of this
surplus toward your support for this two month extension. Here is
the situation as 1 understand it:

Access 4 rayetteville will have to pay for the
preparation of its federal Tax return for 1992. Shea
Crain checked witn Rosanne Gonzaiei, Access 4's
Accountant, and was told preparation of this return would
cost no more than $300. This is a 1992 expense;
therefore, that amount will be deducted from your surplus
amount.
According to our contract, Access 4 is to reimburse the
City up to $500 to be included in the City's Financial
Audit. This amount will be taken from the surplus, thus
this obligation is cleared.
In April, 1992, the Cable Administration Office purchased
$687.40 worth of videotapes for Access 4. This was done
at your request because, at tnat time, you did not have
necessary cash flow established to purchase the tapes
yourself. As of today, tapes in the amount of $364.12
have been used on government programs. That leaves a
balance of $323.28 worth of tapes still due the City.
Since we want Access 4 to continue producing the City
Council, Cable Board and other public meetings for the
government channel, we will leave a $200 balance in this
account. 'lo do this, $250 will be deducted from the
surplus attributed to 1992.

Since we are extending your current contract tor two months,
your 1992 surplus in the amount of $6,/09.31 should be appised
toward your operating expenses for Aprsi and May. she City will
support you with a payment of $4,401.73 to supplement this surplus,
brlnging your total support from these two sources to $11, 111.10
for April and May. That is the original amount agreed upon in our
contract.

please give me a call. if you agree to tnese terms, please sign
under my name and return the original to Shea Cram. She will
provide you with a copy tor your records.

Dear Ms. Zinke:
The City would like to extend the Access 4 Fayetteville contract with the City, for
public and government access television services, for one month, through June
30, 1993. For the month of June, the City will pay Access 4 Fayetteville
$5,555.55 which is the monthly allotment specified in this contract.
If you agree to this extension, please sign below and return the original to my
office. We will provide you with a copy for your records.
Plans are to bring the proposed contract with Access 4 Fayetteville, for public
access services, to the City Council June 15, 1993.
