RESOLUTION NO. 162-92

A RESOLUTION AUTHORIZING THE USE OF A PORTION
OF THE HIGHLAND STREET RIGHT-OF-WAY BY TOTAL
HOLDING COMPANY (ROADRUNNER) FOR THE PURPOSE
OF INSTALLING A TREATED GROUNDWATER DISCHARGE
LINE.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorizes
the use of a portion of the Highland Street right-of-way by Total
Holding Company (Roadrunner) for the purpose of installing a
treated groundwater discharge line.
Section 2. That the authorization for use of street right-
of-way granted in Section 1. abover is specifically conditioned by
the following:
1. The City shall be given three days written
notification of the start of construction;
2. The Total Holding Company's right to be in the
right-of-way shall be subsidiary to the right
of the City and other public utilities and any
relocations required by the City or the other
public utilities in the future shall be at the
expense of Total Holding Company;
3. The line shall be abandoned immediately after
its use is no longer required and shall not be
used for any other purpose and the line shall
be physically disconnected from the inlet box;
4. The Total Holding Company shall be responsible
for all damages to public and private property
incurred during construction.
