HomeMy WebLinkAbout136-92 RESOLUTION1 Pi' RESOLUTION NO. 136-92 MICROFILMED A RESOLUTION CLARIFYING THE INTERPRETATION OF SECTION VII -3, 3), POLITICAL ACTIVITY RESTRICTED, OF THE CITY OF FAYETTEVILLE PERSONNEL POLICY, TO NOT REQUIRE A PRESENT CITY EMPLOYEE TO RESIGN IF THEY BECOME A CANDIDATE FOR THE SAME OR EQUIVALENT POSITION NOW HELD. WHEREAS, the City's current personnel policy was promulgated for the city manager form of government, with the only elected officials being the board of directors; and WHEREAS, the intent of Section VII -3, 3), Political Activity Restricted, of the City of Fayetteville Personnel Policy was to prevent a city employee from running for the Board without resigning from their city employement; and WHEREAS, a change in the form of government was not considered in the drafting of this personnel policy; and WHEREAS, to require an "incumbent" appointed city employee to resign in order to become a candidate for the same or equivalent position now held was not the purpose of the policy; and WHEREAS, requiring such resignations would leave the city without the experience of these individuals during the transition period and would not be of benefit to the city. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: 5ection 1. That the Board of Directors hereby interprets Section VII -3, 3), Political Activity Restricted, of the City of Fayetteville Personal Policy, as not requiring a present city employee to resign if they become a candidate for the same or equivalent position now held.
