A RESOLUTION AUTHORIZING SETTLEMENT IN THE
CASE OF C. THOMAS PEARSON, JR. VS. CITY OF
FAYETTEVILLE, CASE NO. CIV, 92-641, TO ACCEPT
$200.00 IN SETTLEMENT AND ALLOWING TWO SETBACK
VARIANCES AND USE OF 2 FEET OF CITY STREET
RIGHT-OF-WAY, TO INSTALL SUPPORTING POSTS FOR
A BALCONY, ON PROPERTY LOCATED AT 426, 428 AND
430 W. DICKSON.
BE IT RESOLVED HY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors hereby authorizes
settlement in the case of C. Thomas Pearson, Jr. vs. City of
Fayetteville, Case No. CIV. 92-641, accepting $200.00 in settlement
and allowing a 5 foot variance to the front setback and a 5 foot
variance to the side setback on the property located at 426, 428
and 430 W. Dickson St.; and further allowing, as part of the
settlement, the use of 2 feet of City street right-of-way on the
Dickson Street side of the above property, for the purpose of
installing a balcony and/or posts therefore.
