RESOLUTION NO. 101-92
A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A CONTRACT WITH BOB CALLANS
AND ASSOCIATES IN THE AMOUNT OF $17,766, PLUS
A CONTINGENCY OF $1,777, FOR A TOTAL OF
$19,543 FOR DESIGN DOCUMENTS FOR LANDSCAPING
THE NEW 32 ACRE ADDITION TO WALKER PARK.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Mayor and City Clerk are hereby
authorized and directed to execute a contract with Bob Callans and
Associates in the amount of $17,766, plus a contingency of $1,777,
for a total of $19,543 for design documents for landscaping the new
32 acre addition to Walker Park. A copy of the contract authorized
for execution hereby is attached hereto marked Exhibit "A" and made
a part hereof.

AGREEMENT FOR LANDSCAPE ARCHITECTURAL SERVICES
This agreement is between THE CITY OF FAYETTEVILLE (hereinafter
referred to as the Client) and BOB CALLANS AND ASSOCIATES
(hereinafter referred to as the Consultant).
A. PROJECT NAME:
WALKER PARK EXPANSION PROJECT
B . LOCATION/SITE DESCRIPTION:
A part of the East half (E 1/2) of the Northeast quarter
(NE 1/4) of Section Twenty One (21), Township Sixteen (16) North,
Range Thirty (30) West, being more particularly described as
follows: Beginning at the Corner of said Section 21: thence
S 00.32' W, 1982.40 feet along the east line of said Section 21
to the South line of Thirteenth Street; thence along the South
line of Thirteenth Street N89.19'1l"W 808.20 feet to the West
line of Block Avenue; thence along the West line of Block Avenue
N 00°32'E 1982.40 feet to the North line of said Section 21;
thence S 89.19'11"E 808.20 feet to the point of beginning
containing 36.61 acres, more or less, Washington County,
Arkansas. LESS AND EXCEPT a part of the Southwest Quarter (SEQ)
of the Northeast Quarter (NEQ) of Section Twenty One (21).
township Sixteen 4160 north, Range Thirty (30) West, being more
particularly described as follows: Commencing at the Northeast
Corner of said forty acre tract; thence N 89619'11"W 20.00 feet;
thence S 00.32'W 20 feet to the true point of beginning, said
point being a set iron; thence S 00.32'W 50.00 feet to a set
iron; thence N 89.19'11"W 150.00 feet to a at iron; thence
N 00'32'E 50.00 feet to a set iron; thence S 89019'11"E 150.00
feet to the point of beginning containing 0.17 acres, more or
less, Washington County, Arkansas. The above described tract
encompassing Blocks C, D, E, £, and G, of Archibald Yell
Subdivision, Fayetteville, Arkansas.
C. SCOPE OF SERVICES:
(NOTE: This 60 day contract will commence only when the
correct documentation of survey boundaries, site specifics and
vegetation location has reached the hands of the landscape
architect.)
1. SURVEY:
A. Select engineer/survey team to conduct services.
Visit site with engineer/survey team.
B. Provide survey crew with vegetation identification
team member who will select plant material to be

located on the site. Landscape architect will
select necessary site amenities to be added to the
survey.
C. Reproduction of plat at appropriate scales by survey
sub -contractor.
2. MOBILIZATION:
A. Visit site for reconnaissance and photos.
B . Meet with the Client to establish preliminary goals
and objectives.
C. Gather existing information from Client and other
consultants, including topography, vegetation,
clarification of deed, etc.
3. PROGRAM DEVELOPMENT PHASE:
A. Attend general public meeting held by park officials
to gather information for program.
B. Develop a program of uses, ranked by priority, in
cooperation with Fayetteville Parks and Recreation
staff.
Establish Priorities.
C. Develop conceptual ideas for master plan.
D. Develop Parking Study for intended park uses.
4. CONCEPT PHASE:
A. Prepare further site inventory to be added to survey
information.
B . Prepare site analysis, in rough form, based on
collected information.
C. Prepare a preliminary concept plan.
D. Review with staff.
E. Render and mount the concept plan.
5. PUBLIC REVIEW PHASE:
A. Present plan to Parks and Recreation Board in
conjunction with general public meeting. Proposed
order of development phasing submitted with this
initial plan.
B . Revise plan if necessary.*
C. Present plan for second time to Parks and Recreation
Board alone, Phasing Plan will accompany
presentation.
D. Revise plan if necessary.*
E . Present plan for third time to Parks and Recreation
Board at general public meeting. Phasing Plan will
be accompanied by general preliminary cost estimate
for each phase.
F. Present final Master Plan and preliminary cost
estimate to City Board.
NOTE: This contract calls for a maximum of only two
revisions to this plan without additional charges

being added to the contract amount. It also calls
for a maximum of one general public heating, three
parks and recreation board meetings in conjunction
with two general public meetings and one city board
meeting. For additional rate charges which apply in
case of extensions of this contract, see Sections F.
G, and H following in this document.
6. WRITTEN DOCUMENTATION PHASE:
A. Prepare a booklet of Walker Park Expansion Project
which summarizes the intent of the park design and
study.
H. Submit ten copies to the Parks and Recreation staff
for submittal to the Parks and Recreation Advisory
Board and City of Fayetteville Files. this document
will include 8 1/2 x 11 reductions of all master
plan drawings.
C. General phasing development can be modified and
re -estimated in the future at additional rate
chargee.
D. FEES:
Professional fees are quoted below an a lump sum basis:

E. EXCLUDED SERVICES: The following services will not be provided
unless authorized by the Client with an approved change order.

F. REIMBURSABLE EXPENSES:
Reimbursable expenses will be charged as a lump sum,
corresponding to the percentage of completion of each
month's work. This cost is listed in the fee structure,
Section D. If any change orders necessitate additional
reimbursable expenses, these will be billed to the client in
the same manner. These include but are not limited to:
1. A11 photography and blueprinting expenses.
2. Messenger services
3. Postage
4. Long distance phone bills
5. Photographic expenses
6. Maps and other documents pertaining to the project.
All additional services must be approved by the
Client before the charges will be billed.
G. ADDITIONAL SERVICES:
At the direction of the Client, a change order request for
additional services will be prepared and must be approved by
the Client before the work of additional services will
commence. Compensation will be defined in the change order
as: lump sum; time, excluding reimbursables, not to exceed;
time and reimbursables; open end.

Agreements charged on an hourly basis will be invoiced based
on the task preformed in quarter hour increments.
I. PAYMENT:
Invoices will be prepared and mailed to the Client based on
the percentage of completion of each phase of work, and for
outstanding reimbursable expenses on a monthly basis.
Payment is due on receipt. Invoice amounts which are not
paid within thirty days will be subject to a one and one
half percent (1 1/2%) late charge, compounded monthly. In
order to cause an adjustment to any invoice, the Client
must notify the Consultant of any discrepancies within 14
calendar days of the invoice postmark.
Consultant reserves the right to employ collection meaaurea
if the Client's account is 90 days or more delinquent. The
prevailing party in any dispute regarding payment of
fees will be entitled to reasonable expenses for collection
and/or legal services.

Client may not withhold payment from Consultant, for
services completed, due to abandonment of the project.
Consultant's hourly fees may be revised once annually.
J. CLIENT PROVIDED INFORMATION:
All information shall be provided by the Client in a timely
manner, proceeding the work in progress.
1. Information pertaining to the project site, including
but not limited to: legal description, ownership,
easements, encroachment, restrictions, zoning, surveys,
property lines, topography, utilities, structures, soils
reports, geological reports, environmental reports.
2. Project program and objective, including special
requirements.
3. Budget for all construction items. (Budget shall meet
or exceed minimum amount necessary to comply with standards
for governing agencies.)
4. Any new or additional information which may arise during
the term of this agreement which may affect the scope of the
landscape architect's work or the time frame in which this
contract is to occur.
5. Identify the role of other consultants on the project if
any.
A. CONSTRUCTION BUDGET:
Consultant's construction cost estimates will be made based
on experience, judgement and research. Consultant cannot
anticipate fluctuations in the cost of labor, materials and
economic cycles. Therefore, the Consultant does not
guarantee that bids will match estimates prepared for and
submitted to the Client.
L. TERMINATION OF AGREEMENT:
Either party may terminate this agreement by written
notice to the other party. Consultant shall be paid for
professional fees and reimbursable' incurred to the date of
receipt of written notice.
M. OWNERSHIP OF DOCUMENTS:
Client retains ownership of original documents. Consultant
will not be required to provide additional prints outlined
specifically above in this contract. The Client will
provide any additional prints required during the
construction phase of this contract.

N. CONTRACTOR'S RESPONSIBILITY OF INSURANCE:
Architect shall procure and maintain during the life of this
contract workman's compensation insurance as required by
applicable state law for all of his employees to be engaged
in work under this contract and contractor shall require
sub -contractors to provide the same.

Sign and return one complete copy. Proposal is valid for

Dear Bob Callans and Associates,
This letter is serving as written notice that the agreement
between the City of Fayetteville and Bob Callans and Associates for
the Senior Citizens Recreational Facility at Walker Park donated
land be canceled. All of your fees and reimbursables have been
paid to date. I understand that the senior citizens program will
be transferred across the street to the Walker Park Expansion
Project. Thank you for your services.
