RESOLUTION NO, 93-91
AN RESOLUTION AUTHORIZING LAND ACQUISITIONS TO
PURCHASE WATER AND SEWER LINE EASEMENTS ON
PROPERTY LOCATED ON THE WEST SIDE OF GARLAND
AVENUE OWNED BY KEN MOURTON AND APPROVAL OF A
BUDGET ADJUSTMENT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the Board of Directors authorizes a land
acquisition in the amount of $17,750.00 for payment to Ken Mourton
for Easements 1, 2, 3, 4, 5, 6, 7 and 8 in order to obtain
waterline easements and sewerline easements on the property
described in Exhibit A attached hereto and made a part hereof.
Section 2. TheBoard of Directors hereby authorize a
budget adjustment in the amount of $17,750'from Acct. No. 540-000-
1-800.99, Water & Sewer Fund Balance into the Acct. No. 540-570-5-
810.00, Easements. A copy of the budget adjustment for approval is
attached hereto and made a part hereof.

Section 3. The Board of Directors hereby determines that
the immediate acquisition of the described easements are necessary
for the City to provide efficient water and sewer services and that
the provision of efficient water and sewerline service is essential
to the public health, safety and welfare. Therefore, an emergency
is hereby declared to exist and this ordinance being necessary for
the public health, safety and welfare shall be in full force and
effect from and after its passage and approval.

Legal Descriptions
A 15' Sewer Easement, being 7.5' either side of a
Centerline described as follows, to -wit: Beginning at a
point S01°11'50" W 137.44' and S86°23'O1" W 188.83' from
the NE Corner of said SE' -SE', thence NO2°08'48" E 96.50'
to the South line of Easement #8, containing 1315 sq. ft.
(0.03 acres).
Easement No. 2:
A 15' Sewer Easement, being 7.5' either side of a
Centerline described as follows, to -wit: Beginning at a
point S01°11'80" W 137.44' from the NE Corner of said
SE's -SES, thence S86`23'O1" W 188.83', thence N73°21'08"
W 327.31', thence N73°32'56" W 263.78' to the North line
of said 40 -acre tract, containing 0.27, more or less.
Easement No. 3:
A 15' Sewer Easement, being 7.5' either side of a
Centerline described as follows, to -wit: Beginning at a
point S88°33'10" E 559.03' and S73°32'86" E 108.01' from
the NW Corner of said 40 -acre tract, thence S01`17'06" W
214.93' to the Centerline of Easement #4, containing
2,789 sq. ft. (0.06 acres), more or less.
Easement No. 4:
A 30' Waterline Easement, being 7.5' to the South of and
22.5' to the Northof a Centerline described as follows,
to -wit: Beginning at a point N01`11'50" E 1061.67' and
S89°33'30" W 107.50' and S83°57'51" W 29.83' from the SE
Corner of said SE' -SE;, said point being the intersection
of the North boundary of the above-mentioned access road
and an 8" waterline, thence N68`29'07" W 70.09', thence
N86°55'20" W 60.40', thence N89°06'29" W 207.95', thence
N88°49'59" W 192.21', thence N85°43'09" W 220.96',
N81610'38" W 109.16' to the West line of the above-
described property.
Easement No. 5:
A 30' Water & Sewer Easement, being 5' to the West and
25' to the East of a Centerline described as follows, to -
wit: Beginning at a point S88°33110" E 325.00',
S01`11'S0" W 217.99', S81°10'38" E 109.16' and S85°43'09"
E 220.96' from the NW Corner of said SE's -SE', thence
S21°28'O1" W 181.56' to the South line of the above-

to the North line of said 40 acre tract, thence
