TO DO SURVEY, EASEMENT, AND PLAT WORK REQUIRED FOR EASEMENT AND PROPERTY ACQUISITION FOR THE AIRPORT. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE,.ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute Task Order No. 3 to the engineering contract with McClelland Consulting Engineers, Inc. to do survey, easement and plat work required for easement and land acquisitions for the runway protection zones andtransitional surfaces purchase project at the airport. A copy of the task order authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 21st day of May , 1991. F .e r i 4g- - APPROVED: t•".t e rfl „ATTEST: 1, ,`4 ti 4 , 1!. =By : /� N -'lS� f4arys?O/J� City CNerk _ . - : - i. j t f * 1 I. -c Mayor t TASK ORDER NO. 3 LAND ACQUISITION AND AVIGATION EASEMENTS FOR RUNWAY APPROACH SLOPES DRAKE FIELD, FAYETTEVILLE, ARKANSAS This Task Order is hereby made a part of the Basic Agreement executed September 21, 1989 between McClelland Consulting Engineers, Inc., (ENGINEER) and the City of Fayetteville (OWNER) in accordance with the provisions of that Agreement. ARTICLE 1 The Owner and Engineer have completed an Obstruction Study for the Approaches into Drake Field with acceptance by the FAA. The results of this study and recommendations from FAA indicate that numerous easements and property acquisitions are required in order to control the height of objects or to .mark obstruction with obstruction lights within the approach slopes to Drake Field. The Owner and the FAA have agreed to change funding priorities in order to acquire the property and easements on a first priority basis. Therefore, Task Order Nos. 1 and 2 executed between the Owner and the Engineer are hereby modified. Task Order No. 1 is to be considered Null and Void following payment for services rendered through February 1, 1991. Task Order No.'2is hereby modified to delete "Project I, Phase II Obstruction Removal/Lighting" from Article 1 and from Article 2, paragraphs 2, 3, 4, and 5, thereby decreasing the fee under Task Order No. 2 by $58,500.00. The Owner wishes to obtain property within the Runway Protection Zones and easements within the Part 77 Surfaces for the 34:1 Non - Precision Approach to Runway 16 (Northend) and acquire property 20:1 and easements within the Part 77 Surfaces for the Visual Approach to Runway 34 (South end) under FAA Grant No. AIP 0020-11 and future grant. The Engineer will provide the following services necessary to provide Property Deeds, and Property Ownership, complete property surveys, plats of survey and easement, as required to acquire the property and/or easement to meet FAA Criteria. 1. Perform a record search to determine present property boundary description, ownership, name and address, and any existing avigation easement. Develop a Property Map indicating parcels of land to be acquired by fee simple title and parcels to acquire by avigation easement. 2. Perform field surveys to determine the property boundary locations for approximately 28 property acquisition tracts and approximately 86 avigation easement acquisition tracts. Prepare plats of survey for property or easement acquisition and a profile of easement tracts indicating the height limitations. Field staking for the property boundary corners and easement boundary corners. 3. Provide assistance to Acquisition Consultants and to Airport and City staff during the acquisition process. 4. Perform Project Management duties including meetings with Surveyors, Airport Property Acquisition Consultants, Airport and City staff and FAA as required; provide letters to property owners; and overall project management for related ownership search, surveying and plat preparation activities. ARTICLE 2 The compensation for services to be provided in Article 1 above shall be according to the following schedules: 1. For development of current property ownership deeds, names, addresses, and existing avigation easements by an abstractor at an hourly rate of $35 per hour. An amount not to exceed $ 5,000.00 2. For the development of property map indicating parcels designated to be acquired by fee simple or by avigation easement: ' A lump sum amount of $ 4,300.00 • 3. For the field surveying and office computation required to locate and determine property boundary, corners for simple parcels and easement ,boundary corners for easement acquisition parcels, a fee per parcel to be determinedfrom actual direct labor, payroll cost, direct non -payroll cost, indirect cost and profit in accordance with the attached Exhibit "A" incurred divided equally between all parcels within Corporate City Limits and equally between all parcels lying outside the Corporate City Limits within the County. The maximum fee for parcels within Corporate limits shall not exceed $820.00 per parcel. The maximum fee for parcels • lying outside the corporate City Limits within the County shall not exceed $1,250.00 per parcel. The fourteen (14) parcels for which field surveys completed under the AIP 3-05-0020-11 Grant will not be subject to a fee under -this project. Several separate parcels under the same ownership may be combined for acquisition purposes there by reducing the number of total parcels and the total fee. An amount not to exceed $85,900.00 • 4. For the preparation of Descriptions and property survey plats and easement description and easement plats (2 per parcel required by FAA), a fee per parcel to be determined from actual direct labor payroll cost, non -payroll cost, indirect cost and profit in accordance with the attached Exihibit "A" incurred divided equally between all parcels. The maximum fee per parcel shall not exceed $520.00. The fourteen (14) parcels for which easements were prepared under the AIP 3-05-0020-11 Grant will have a maximum fee of $300.00 for required revisions. An amount not to exceed $56,000.00 5. For Project Management and assistance to acquisition consultants and Airport and City staff, A lump sum fee of $ 8,260.00 The Hourly Rate Schedule "Exhibit B: to the Basic Agreement shall be modified according to paragraph 2 of Article 2.
