HomeMy WebLinkAbout81-91 RESOLUTIONr Cfr AMENDMENT NO. 1 TO AGREEMENT FOR ENGINEERING SERVICES WATER TRANSMISSION LINE AND WATER STORAGE FACILITIES CITY OF FAYETTEVILLE, ARKANSAS WHEREAS, on July 3, 1990, the City of Fayetteville (the Owner) entered intoan agreement with McGoodwin, Williams and Yates, Inc. (the Engineer), to provide engineering services in connection with design and construction of certain water transmission and storage facilities; and • WHEREAS, the Engineer has, under the terms of the original agreement, completed and submitted the Overall Design Study report; and WHEREAS, the Owner has selected the routing for the 36 -inch pipe line generally following the existing pipe line from the Beaver Water Treatment Plant to a point at Joyce Street, then extending west and south across U. S. Highway 71B to the planned storage tank site on Kessler Mountain; and WHEREAS,• the Owner desires the Engineer to provide detailed design, preparation of plans and specifications, and construction management services for that portion of the project commencing at the Beaver Water Treatment Plant and extending to the crossing of U. S. Highway 71B; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the Owner and the Engineer, the parties hereto, stipulate and agree that the "Agreement for Engineering Services" dated July 3, 1990, is hereby amended in the following particulars. A. Section I is clarified to set out that the Engineer will provide detailed design, plans and specifications, and construction management services for that portion of the project commencing at the Beaver Water Treatment Plant and extending to, including connection with,: the existing 16 -inch water line on the east side of U. S. Highway 71B. B. Section III -B is amended to provide that compensation to the Engineer shall be as hereinafter set out: 1. For preliminary and final design, preparation of construction plans and specifications, and bidding -and preconstruction services, a lump sum amount of $226,900. tr 42. This fee will be payable in eight installments to be due on the following schedule - seven monthly payments in the amount of $30,600 commencing 30 days after authorization to proceed and one final payment in the amount of $12,700 after bids have been received and construction contracts are ready for execution. It is understood and agreed that payments will be accelerated should the work be completed early. 2. For services during construction, payment shall be based on actual time required to perform the work by the various classifications of employees at the following established hourly rates plus a lump sum fixed fee in the amount of $45,000. The estimated cost, based on the established hourly rates, is $226,300. Payment shall be made monthly and shall include all costs accrued plus a pro rata share of the fixed fee. It is understood and agreed that the above lump sum fee does not cover unforeseen contingencies such as default by the contractor, litigation, or other events not normally anticipated. In this event, the Engineer will be compensated for additional time under Section III -A of the original contract. 3. Section II -C provides for assistance in securing the necessary interest in lands and rights-of-way, and Section III -A provides that the method of compensation will be salary cost times a multiplier. The. estimated cost for this work is $14,220. It is hereby agreed that salary cost for this project will be derived by multiplying the cost of base payroll by 1.36. AUTHORIZING AMENDMENT NO. 1 TO THE ENGINEERING SERVICES AGREEMENT WITH MCGOODWIN, WILLIAMS & YATES FOR WORK RELATED TO THE CONSTRUCTION OF THE NORTH PART OF THE 36 INCH WATER LINE AND RELATED SYSTEM TIE-INS. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute Amendment No. 1 to the Engineering Services Agreement with McGoodwin, Williams & Yates for the work related to the construction of the north part of the 36 inch water line and related system tie-ins in the amount of $512,488.00. A copy of the contract authorized for execution hereby is attached hereto marked Exhibit "A" and made a part hereof. PASSED AND APPROVED this 7th day of May , 1991. APPROVED: xr..
