BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: 'Section 1. EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT the undersigned e Grantor, for and in considers ioof the sum of One Dollar ($1.00) and other good and valuable consideration in hand paid by the Springdale Water and Sewer Commission, Springdale, Arkansas, do hereby grant, bargain, and sell unto the said Springdale Water and Sewer Commission, Springdale, Arkansas, and unto its successors and assigns, an easement for a sewer collection line over, under or across the hereinafter described land in WASHINGTON County, Arkansas, to wit: A 15 ft. easement, 7.5 ft. either side of an 8" P.V.C. gravity sewer maindescribed as follows: Part of the SE1/4 of the SW1/4 of Section 13, T -17-N, R -30-W of the Fifth Principal Meridian, Washington Co., Arkansas, more particularly described as follows: Beginning at the N.E. corner of the said SE1/4 of the SW1/4 thence South 680.42 ft. and 295.04 ft. West to a point on the South right-of-way of Lake View Road and the Point of Beginning, thence South 00°00'08" East 317.5 ft. to the North easement line,of and existing Springdale 8" P.V.C. sewer main, thence with said easement line West 15.00 ft., thence leaving said easement line North 00°00'08" West 317.5 ft. to the said South right-of-way of Lake View Road, thence with said South right-of- way East 15.00 ft., to the Point of Beginning, containing 0.11 acres more or less. Together with the right to ingress and egress over and across adjacent lands for the purposes of laying, repairing, inspection, maintaining, removing or replacing said sewer collection, and the right of exercising all other rights necessary to carry out the purposes for which this easement is created. TO HAVE AND TO HOLD the above described easement and rights unto said Grantee, its successors and assigns, forever or until said right of way is abandoned. And Grantor agrees to warrant and forever defend all and singular the above described easement and rights unto said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or seek to claim the same or any part thereof. This Easement is declared to and does insure to the benefit of the public generally, and shall be binding upon the successors in title to the lands herein described or any part thereof, their mortgagees, lessees, heirs, administrators, executors, successors and assigns.
